Just copy any other defence.  Don't overthink this. We have several per day on here.

Very easy.  Only one paragraph needs adding to the Template; that thread tells you what to put.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • I don't suppose anyone knows the correct email to send to DCB solicitor? Can't find it searching the forums. Is it just the info@dcblegal.co.uk or whatever is on the letter?

Just use the info@ address. No need to overthink this.

You don't need to respond to the letter. It's optional.

Just wait for the claim form in the post.
  • So have received the claim form in the post today issue date, but it does not include an N180 form like the newbie thread says, its a response pack with an admission N9A form and a defence and counterclaim N9B form. Do you receive a response after filing an AoS to let you know you've extended the time to form a defence to 4 week? Given that another poster has today posted their DCB legal response to their defence which intends to pursue the court case I don't hold out much hope for my own claim given that I've not even got a defence yet. My partner was diagnosed with a serious mental health condition around 4 months before the ticket, could this form part of my defence?

The N1SDT  claim pack never includes the N180 form. !

They send that form several weeks after yours defence has been submitted to the CNBC, so in 2 or 3 months time

One step at a time for the moment. I have previously told you to follow the process, step by step

What is the issue date on the claim form. ?

Post a redacted picture of the POC on the bottom left of the claim form, after hiding the VRM details

Please change your thread title. Thanks!
By this I meant please remove the "should I just pay it" jarring question which you know is not necessary.  The title is no better!

  • Hello, please advise which of the following defences should I use to fight a DCD legal case. I currently have 3 options:

    Poor signage:

"The Defendant contends that the car park markings indicating its private status were significantly faded and therefore not clearly visible upon entering the car park. Additionally, the signage indicating pay-and-display requirements is oriented parallel to the direction of traffic entering the car park. This positioning, particularly for drivers approaching from the left side, did not provide adequate or clear notice of the terms and conditions associated with parking. As such, the Defendant believes that the visibility and clarity of the parking instructions were insufficient to establish a binding contractual obligation to pay."

    Can't remember:

"The Defendant does not have a clear recollection of the specific details of the alleged parking incident, given the significant time that has elapsed since the event. However, the Defendant maintains that any signage or terms relating to parking charges were not clearly communicated or adequately visible at the time."

    Mental health:

"The Defendant states that during the time of the alleged incident, she was recovering from a significant mental health episode that occurred in March 2020, which impacted her decision-making and understanding of information. This condition may have affected her comprehension of any parking requirements. The Defendant maintains that if signage or terms were present, they were not clearly visible or sufficiently highlighted to ensure understanding."

Are these defences too specific? Am I overthinking it?
