    In August 2021 Google Street View shows this at the entrance to the car park...

         

    That banner is blank on a later GSV image.

    Of course things might've changed since then, but surely a phone call to Lee Baron on 0207 758 5600 is worth a try. If they are no longer 'in control', then perhaps they can tell you who are running the show now.

    So just an update.

    I am currently in discussions with the landowner (lee baron) who is being pretty obstructive when it comes to cancelling the PCN.

    I have mentioned that I have shopped there at the park and was astounded to have been given a PCN given that I have spent money there.

    If the landowner doesnt get the PCN cancelled - is there anything else I can do?

    So just to confirm. Do I draft a POPLA appeal or just wait it out until a court summons?

    And if asked to go to court what do I do? Just repeat my initial arguments above? Is that realistic?

    I am just worried about getting a CCJ and not being able to defend the claim - is it worth paying to avoid all this back and forth?
  • There is still a long way between receiving PCNs (complaining to landowner) to receive a small claim form (i.e., court "summon") 

    You are likely to be encouraged to appeal by parking companies knowing that most appeals are rejected (appeal to the parking company and/or appeal to their so call 'independent' appeal service). Then you will receive further letters from parking companies, demanding money.

    Then, you will receive letters from the debt collectors, demanding more money. There may be multiple letters. 

    Then you will receive a LOC/LBC, letter of claim or letter before claim from the debt collectors. Then you will respond using the template in the NEWBIE THREADS.

    Then you may receive a small claim form, that's when the defence starts... You will need to respond, timely. If you do so, there won't be CCJ. CCJ may happen when you do not respond to the court letter on time. 

    All are in the NEWBIE THREAD. You will need to read a few times to get familiar with it. It is quite challenging in the beginning, but the more you read, the better you will understand about this process.

    You definitely cannot and will not receive a summons ( its not a criminal matter. )

    If you keep following the advice on here then you won't receive a CCJ either 

    Study the newbies sticky thread if in doubt 

    Also study a few court claim threads, because you will see that most of the defence etc is paperwork, in stages, not parroting in court

    No it's not worth paying.

    You are NEVER risking a CCJ even if you lose.

    Defending is easier than doing an appeal.

    No it's not worth paying.

    You are NEVER risking a CCJ even if you lose.

    Defending is easier than doing an appeal.
