OK so an update.
Received a letter from the courts for an "in person" hearing. They have stated:
"Unless the claimant pays the trial fee of £27 by 12 of February, the claim will be struck out".
Separately, I received an email from the solicitors for the claimant stating that they will be willing to settle without prejudice at £60.
This is of course tempting given I cannot be arsed heading to court, and even more so, no idea what my defence will be.
What would people recommend? Is it a game of chicken I am expected to win?0 -

In theory you could email them just the costs assessment on Monday 5 January stating that you will embark on the WS in 48 hours time and your costs will amount to 3x £24 = £72.Therefore if they do not issue their Notice of Discontinuance within the next 48 hours and wait until you have completed the work, you will be submitting the costs assessment to the judge, citing unreasonable behaviour and late discontinuance and attend a costs hearing should needs be, which will attract additional costs.
They either discontinue and you don't have to bother with the WS, or they ignore you. In the latter case you have further evidence of unreasonable behaviour for gaining costs.
You can play hard ball with DCB Legal. Any deviation from their business model where they might lose money or have to make an effort spooks them. There's a reason they don't bother filing 500 witness statements a week.3 -
