    Not necessarily. A lot of hearings are remote (phone or video call) and the D can have someone help them with that, if needed.

    Haven't seen a Napier case even go to a court claim in months. Highly unlikely and nothing to worry about.  I cannot see a case where the driver is protected by the EA 2010 being a good litigation bet for them. The driver was entitled to more time for their money which the Norwich & Lincoln Council cases explain.

    Also consider this:

    Letting a case go to a claim is NOT the same as letting it go to a hearing.

    Several stages in between, including a compulsory independent Court Mediation phone call, where cases can be settled for as little as £20 (or even zero) if the discussion goes that way, if they want to make an offer to make it go away.

    Court claim stage is better than this stage.

    Hi @coupon-mad I intercepted and ignored all letters and was awaiting a letter such as LBC or court claim. I’ve not received anything like this until now - today received an HM Courts & Tribunal Service letter with Claim Form, with 14 days to respond. Should I have received something before this? What should I now do? Thanks

    Follow the guidance in the NEWBIE sticky and specifically the Dropbox link that shows how to complete the AoS.

    You've left your claim number showing and your VRM.  You still need to follow the guidance and do the AoS but not before Wednesday morning to get the benefit of 5 days for service.

    Then wait a week because I am about to shorten the Template Defence this week and I will change the advice so people put defences in on the MCOL system, not by email.
