Yes. See post 4 of the NEWBIES thread.

And the good thing is that DCB court claims are the easiest to see off when that happens.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hi just a bit of an update. Still heard nothing in the mail about a legal claim.

I have a question tho, originally when I panicked i called DCBL to ask for an extension as I wasnt aware of the process etc. They called me today but i put the phone down straight away. My question therefore is, will they still send me a letter of claims even though they have my phone number? Not sure if they would make the process go through without sending me a letter, but instead just calling me. And do I block this number now?

    Many Thanks

Block it, wait for letters in the post, no phone calls whatsoever

The claimant parking company has 6 years to sue you in court, so plenty of time for them to issue the letters or claim
  • Hi total newbie here.

I'm reading this with interest. I had a similar experience.

Was issued with PCN for parking at gym on 26/9/23. Likewise there was a portal that didn't register my entry.

Appealed with proof provided by gym that I was attending at the time, so had right to park there.

Heard nothing until 3 January, enclosing a letter they said they sent me on 28 October which I didn't receive:

Replied on 8 January f2024 with the following on their online form:

With reference to your letter of 3 January 2024. You finally included the letter you say you sent me on 28th October. As in my previous appeal I stress that I DID NOT RECEIVE THIS LETTER.

I dispute receipt of this letter and  ask you to provide proof of postage or proof of receipt.

I had a right to park in that car park that morning and have supplied you with proof that I was at the Merton Abbey Nuffield that morning, although you say I have not provided evidence, which in itself doesn't make any sense, so please explain to me how that isn't enough proof?

Logic dictates that I would not have ignored this letter and indeed, would have paid the suggested amount of £20, just to close this claim. If not, I would have taken my claim to POPLA. But again, I stress, I did not receive this correspondence.

You state that it is now too late to go to POPLA, but I never had a period when I could have gone because I didn't receive the letter of 28 October!

I would ask you to please reinstate the £20.

    Again I was totally ignored.

Then nothing till I received the same dcbl letter as you.

I'm going to follow to see what happens with you. I'm totally prepared to go to court because I think the way they constantly ignore what I send is unacceptable.

Nothing to be concerned about there.
Offering you 14 days to pay puts this firmly in the realm of a debt collectors letter.
The fourth post of the NEWBIES thread explains exactly how to deal with debt collector's letters, but to summarise that post - ignore them.

Also, the wording of their third paragraph makes it clear that this letter is not a Letter of Claim.

Okay thanks for the speedy response. You guys are good people. Just annoying they leave months between these letters as at the time I do research and become semi-clued up on the process and now after months later I forgot everything..

Seems to not be a letter of claim you’re right and I will ignore them. I just semi-remember something about if its from the Legal and not limited people then I shouldnt ignore, but will listen to your advice. thanks again
