    Just a TRY-ON from DCBL, it's their favourite game. 
    They know the  case is rubbish and what follows that letter is a discontinuation.
    As it's a long time away from the court hearing, they will string it out and even send more junk to you, maybe a better offer which you just ignore. Let them waste their time. As said, block the pest phone calls.

    Tell your wife no to worry, it's a money scam.  Apart from her reading the famous DCBL DISCONTINUATION thread

    This means the case has been transferred to your local court for allocation. The court will write again, most likely with a notice of a hearing containing 3 important dates:

    When the hearing will be held
    When the Claimant (Not the Defendant) must pay the Hearing Fee
    When documents must be filed (Witness Statements etc.)

    Normally the fee due is first, then the document filing deadline but sometimes it will be documents first.

    Make a note of the deadlines and if the fee is due first, check it has been paid before bothering with a Witness Statement.

    Also, block DCB Legal's number and report them to the ICO as harassment.

    HELLO there, I just wanting to know how do you find out if the court trial fee has been paid? I'm in a similar situation and want to find out if its worth the hassle doing a witness statement.

    Just ignore them.

    They'll discontinue soon, as they don't want a long wait to a hearing they'll never send anyone to attend.

    Clever Judge though, flushing this down the toilet early:
    both parties have until the 28th May to 'deliver to the other party and court office copies of all documents on which that party intends to rely at the hearing'. 

    That means your NoD will arrive this month. Show us when you get the email, but we need to see the NoD to count it!

    Thank you so much for your help so far. Do I need to bother sending documents to DCB and a Witness Statement? If so, is there some template or guidance on what to send? I don't want to go through all the hassle of doing this if they are going to send a NoD soon?

    Hi guys. I have put together a witness statement for my wife and have cut and pasted below. I removed any information regarding personal details of the case. Can someone please tell me if this is acceptable? I have never had to do anything like this, so if it is totally off track please let me know where I've gone wrong. 

    If it's OK, I'm assuming I need to send a copy to DCB Legal and The Court? Is emailing acceptable?

    Claimant: Euro Car Parks / DCB Legal

    Defendant: XXXXXXX

     

    1. On XXXXXX, my husband and I visited a local restaurant to celebrate our Wedding Anniversary. My husband was the driver of the vehicle, XXXX XXX (which is registered to myself), and chose to park in XXXXXXXXX car park in XXXXXXX town centre.
    2. I cannot remember the exact time of parking, but it was approximately 8pm and dark, so any signage displayed by Euro Car Parks Ltd was difficult to see. Moreover, the car park was practically empty.
    3. We entered the vehicle registration into the payment machine and paid for one hour’s parking.
    4. Unfortunately at the restaurant, the food we ordered arrived on our table with only 15 minutes left to return to our vehicle. When we eventually finished our meals, we arrived back at our vehicle approximately 17 minutes later than the purchased ticket covered.
    5. Approximately 3 days later I received a Parking Charge notice from Euro Car Parks informing me I must pay a ‘fine’ of £60.00.  
    6. After refusing to pay this ridiculously over inflated figure, I have for the past 3 and a half years been subjected to repeated demands from differing Debt Collection firms, the most prolific of which is DCB Legal, who have grossly inflated the figure which I understand includes their own ‘administrative’ costs. They have also constantly hassled me with telephone calls both at home and at work.
    7. After filing a defence with the Court, I was given a date of the XXXXXX 2025 to expect a phone call from the Court Mediator. I booked the day off work to prepare for the call, only to be told by the Mediator that DCB Legal didn’t have anyone available to act as third party. The caused me great inconvenience as I’ve now lost one day’s holiday.
    8. The Mediation call was rescheduled, meaning I needed to take another day’s holiday. This time DCB Legal had someone available as third party, and I was asked if I would like to come to an agreement, to which I replied ‘no, I would like the case to go to Court’.
    9. I totally refute the allegation by ECP and DCB that by staying 17 minutes over time, they have lost revenue by claiming we were taking up a space which could have been used by another customer as, once again, the car park was practically empty.
    10. I feel that the original fine of £60 is a simple cash grab by ECP, as pro rata the figure should only be approximately £0.26 pence. The total amount being claimed now is £295.96.
    11. I believe that the facts stated in this witness statement are true.
