Evening all. So this morning my wife received the call from the Mediator only to be told that DCB Legal didn't have anyone available at their end to take the call and it's been rescheduled for later this month. Surely this must go against them?0

Hi guys. My wife received this letter yesterday. Can someone please explain in layman's terms what it means? Is it something we need to worry about or is it just a change of court reviewing the case?
Also, since her mediation call with DCB over a month ago, DCB have been constantly phoning her to get her to make a deal or ECP will proceed with the case. Is this just bluff?0 -

This means the case has been transferred to your local court for allocation. The court will write again, most likely with a notice of a hearing containing 3 important dates:
When the hearing will be held
When the Claimant (Not the Defendant) must pay the Hearing Fee
When documents must be filed (Witness Statements etc.)
Normally the fee due is first, then the document filing deadline but sometimes it will be documents first.
Make a note of the deadlines and if the fee is due first, check it has been paid before bothering with a Witness Statement.
Also, block DCB Legal's number and report them to the ICO as harassment.

UPDATE:
Good evening guys, hope you are all well and enjoying your BH.
So my wife received a 'Notice of Allocation to the Small Claims Track (Hearing)', and the hearing is scheduled for around the end of November. Two days later she received an email from DCB Legal offering her a settlement figure of £100, and requesting we confirm within 7 days if this is acceptable. I'm sure this is a last ditch attempt to extort any amount of payment from her, but it's still £100 more than we are willing to pay. I want to email a return telling them to 'do one', but is there any sort of template reply to this which, should it still go to court, is a reply which is both professional and favourable to us?
I'm hoping once we reply to their email, they will give up and notify the Court that they no longer wish to proceed. Is it wise to hold off from doing any witness statement for the time being to see if they give up? They have until 30th October to pay the trial fee, and both parties have until the 28th May to 'deliver to the other party and court office copies of all documents on which that party intends to rely at the hearing'.

Just ignore them.
They'll discontinue soon, as they don't want a long wait to a hearing they'll never send anyone to attend.
Clever Judge though, flushing this down the toilet early:both parties have until the 28th May to 'deliver to the other party and court office copies of all documents on which that party intends to rely at the hearing'.That means your NoD will arrive this month. Show us when you get the email, but we need to see the NoD to count it!
