  • Ok, I will do that, cancel payments and ring them explain why.

We are all on Orange, they really only use their phones for music, the games on it and texting, they don't ring hardly anyone. Would Orange just become another creditor if I just stopped paying them and the debt I owed would be what was due on the remaining contract, none of us ever go over out monthly payments eg £35 x 3 phones X 11 months - would that be my debt to them then?

Aside from losing my home obviously, my next biggest fear is bailiffs knocking my door. If the creditors took me to court fine I don't care about telling a judge how much money I have or indeed haven't got but I could not handle bailiffs - will they just call around without going to court?

    Hi, welcome.

You've had some good advice already, keep us updated and try not to panic-this can be sorted out.

The issue with the CSA chasing your payments is something that really needs to get sorted out, as this will make a huge difference-if you are not comfortable talking to the local CAB, I have found their phone and email advice service really useful-can't do links, but if you google it, should come up. In the meantime, keep on at the CSA and make it clear to them that this is totally unacceptable-it is their job to ensure that you are paid the maintenance a court has agreed you are entitled to.
  • I'm in Wales too!! Just called something different but the principle is the same!! Social worker for MH will know!

Ok, will ask, hope I can get a referral now

Thank you, yes I am a little calmer now I am sitting talking to you all about it, my logical mind tells me that this can be sorted but my bank account and figures keep screaming that it wont, if you know what I mean.I am frantically emptying cupboards at the moment for my creditors file, I have no idea of exactly how much I owe and I need to know.

I will do a google for CCCs to see if it can offer some help, thanks
  • Hi there and welcome to MSE :)

Firstly, and sorry for being a bit twee, but I wanted to send you a big virtual squishy hug because you really sound like you need one right now :grouphug: <---- it's a bit dodgy I know, but there you go!

You've had some good advice already, epecially from SS re cancelling your DDs and sending them all a letter with £1 each, explaining your situation (the £1 thing is very important, it shows you're still willing and wanting to pay something).

Re your phones, yes in answer to your question, you could just cancel the DD for these and Orange could just become another creditor. The handsets are yours so you could just get payg sims for them (get Orange ones so they'll work in the handsets otherwise you'll have to pay to get them unlocked). Orange can then just be paid as much as you can afford :)

Hope this helps a little :)
You can't control everything in life....... your hair was put on your head to remind you of that :p

If you stopped paying Orange then yes you would just end up having to pay the remainder of the contracts but they would almost certainly cancel your phone lines. So effectively you'd be paying for nothing. This is why it might be better to reduce the tarrifs, or maybe reduce them then ask them to cancel your contract as a gesture of goodwill. Explain to them that you suffer from depression and you believe you have a good case for these contracts to not be enforcable due to your illness.

It all depends on whether you want a reduced package or whether you want rid of them completely following the advice from In Search of Me.

Ballifs won't turn up at your door unless they have a court order. The only way they can obtain a court order is if you refuse to pay your debts. This is why it's important to send them a token payment of £1. If they went in front of a judge to obtain a charging order (think thats what it's called) they wouldn't stand a chance. A judge would look at your finances and see you are making an attempt to pay them back. :)

Oh dont be nice to me and sending me hugs, I just cry again lol

Right orange can go then, that's a whopping £105 a month, even if I just keep the kids topped up it will be a fraction of that, I think orange are doing free texts now too or something, will have to get some sims
