1) How much it would cost to return a treadmill
2) Any info about your right to cancel.
Looking on Companies House they seem to be a smallish company so I'm assuming they haven't supplied that info and you can cancel within 1 year and 14 days for a full refund with the return costs on them but as above best to double check the emails/paperwork.
On a email they have told me if I'm successful they will send me instructions and the right way to package etc.
If they are trying to say you can only cancel "with their permission", then they are wrong and they are misrepresenting the law.
Regarding the cost of returning the treadmill, my understanding is that you have to pay it unless they have not told you "... for distance contracts, if the goods, by their nature, cannot normally be returned by post, the cost of returning the goods;"
If they didn't tell you beforehand what it would cost to return the treadmill, they must pay for its return - or at least that's how I understand it.
They need to understand (1) that these are statutory legal rights given to you under the legislation referred to previously, and (2) that their T&Cs can't take those rights away from you.
Before you do any more, see what @the_lunatic_is_in_my_head says and whether they agree with me1 -

would you mind to check the emails they sent and any paperwork that comes with the parcel (invoice, etc) please to see if they told you:

I do indeedif they haven't given at least a rough idea of return costs OP doesn't have to pay (or perhaps will be able to attempt to recover the cost of return).

On their site it says any faults not mentioned within 24 hours will not be entertained.0 -

A few of the reviews. I normally always check reviews and feel stupid for not checking.
Rated 1 out of 5 stars13 Aug 2024DO NOT purchase from this outfit.DO NOT engage with this so called company. Ordered a reverse treadmill, tried to cancel within hours but the purchase was apparently processed already beyond being able to cancel. Retuned the item un-opened with full Parcel Force tracking, proof of delivery and they outright refuse to refund me saying they don’t have the item, parcel force must have left on their truck, they have no cctv to prove it was delivered and so on.They are taking zero responsibility leaving me with no refund. This is a shambles of a company.Date of experience: 13 August 2024Graham OReilly4 reviewsGBRated 1 out of 5 stars28 Apr 2024Utter garbage product and rip offUtter garbage product and rip off! Ofcom or whomever regulates needs to be informed. Nothing fit together, the level of quality is just dreadful for a £10 product never mind a £50 product! The comments on their website are mostly fake and they never publish 1-2 star reviews, only 5 stars, because I kept writing 1 star reviews but it never showed, so I know. The metal slant board which is foldable is totally and completely slippery. No way to use it. The product is very overpriced. I asked for a refund and customer service ignored my many emails, telling me it works as intended. Really horrible company.Date of experience: 18 April 20240 -
The main problems with the reverse treadmill is the magnetic resistance hardly works.
If I put it on the incline you have to go extreamly slowly because it just speeds up like slipping on banana skins.
2nd issue it's unstable and I believe health hazard.
There's wear and tear on the resistance cable cord ripped revealing wire.0 -
@JON05 - what we (that is me and I think @the_lunatic_is_in_my_head) are suggesting is that you put to one side for the moment the idea about it being faulty.
Instead we (or at least me) are suggesting that you exercise your statutory legal right to cancel the order under s29 of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (legislation.gov.uk)
That allows you to cancel a distance contract up to 14 days after delivery - and the seller cannot prevent you from exercising that right. You do not need their permission.
The reason the answers to the questions posed by the lunatic are important is because if the seller does not inform you before purchase about (1) the above statutory right to cancel and (2) the likely cost to you of returning the treadmill if you do cancel, then (a) you are entitled to full refund and (b) the seller has to pay for the return.
Can we take it from the answers you have already given this afternoon that they did not tell you about (1) and (2) before you bought the treadmill? Can you clarify?
Of course it might be that you also have an additional or alternative claim that the treadmill is faulty in some way, but can we confirm what they did - or didn't - tell you before dealing with that aspect?
[Edit: and you can forget anything in their T&Cs that is either explicitly or implictly at odds with your statutory legal rights. Their T&Cs cannot override your legal rights. If they didn't tell you about your statutory 14 day right to cancel and if they didn't tell you how much it would cost to return the treadmill, then you can get a full refund and you will pay nothing - or be entitled to be refunded - for the return costs. Forget the !!!!!! about the original packaging and having to notify faults within 24 hours. Both those terms are bolleaux.
But be aware that you may need to sue these idiots - who clearly are ignorant of consumer law - to get your money back...]0 -
@JON05 - sorry, couple of other points. Apologies if they've already been raised:
1. I've assumed this is a distance purchase? eg online or by telephone etc
2. How did you pay? Did you use either a credit or debit card, and if so, which? This might get your money back with a bit less hassle0 -
