  • I’m facing a similar situation with Select Parking. I received two letter about two infractions in early May, but I never received any PCN letters—just  outstanding charge notices from TNC debt collectors, dated August 29th (three months later!). This notice informed me that the appeal period for these infractions had already passed. I also received a Notice of Intention to Instruct Solicitors on September 10th.

    Last week, I sent the “newbie” letter to both TNC and Select Parking Ltd. I received a response from TNC via email on Monday, September 13th, with two photos related to the first infraction. The first photo shows the car entering the parking lot, and the second shows it leaving, but neither includes a picture of the car parked in a space. The email did include the location, date, and time of the alleged infraction. I’ve also requested details regarding the second infraction but haven’t received anything yet.

    Should I appeal to POPLA? Any advice would be greatly appreciated.

    So I received the below from Popla today via email (“acting” on behalf of my partner):

    Select Parking Ltd - EW has now uploaded its evidence to your appeal. This will be available for you to view by clicking here

    Please note: some evidence may not show immediately, if it is not currently available on your account please check back later before contacting us.

    You have seven days from the date of this correspondence to provide comments on the evidence uploaded by Select Parking Ltd - EW.

    Please note that these comments must relate to the grounds of appeal you submitted when first lodging your appeal with POPLA, we do not accept new grounds of appeal or evidence at this stage

    Any comments received after the period of seven days has ended will not be considered and we will progress your appeal for assessment. Therefore, if you have any issues with the evidence uploaded by Select Parking Ltd - EW such as being unable to view it online, please contact POPLA immediately via phone - 0330 1596 126, or email - info@popla.co.uk, so that we can look to rectify this as soon as possible.

    We have reviewed his challenge and would like to address the points raised. Vehicle Location and Duration: Our records indicate that the PCN was issued because the vehicle was observed in a restricted area. the restricted area is a permit only site which is clearly stated on the signage. This car park is one of our biggest multi signed car park, the sign are hard to ignore because they are at 3 m apart around the car park as per photographs and there is also a big entrance sign which has been approved by the British Parking Association. The main issue within this car park is parents visiting A&E Tuition. They are not allowed to park in the car park owned by A&E tuition, hence the abuse the car park opposite for many years hence why the owners of the park have introduced our Select Parking company who are approved contractors with the British Parking Association since 2017, to implement these conditions. Another main issue is our clients are concerned at people visiting their car park in the late hours of the evening when all offices and buildings are closed within the vicinity of the area. The appendant who received this PCN arrived at a very peculiar time in the evening and stayed there for just under one hour which was very alarming to the unit holders who hold expensive products within the warehouses. Our policy requires vehicles to be parked in accordance with the signage present. Stopping or Parking is not exempt from the restrictions set forth by our parking regulations. The PCN was issued in compliance with our operational protocols and in line with legal requirements. In light of this, the PCN remains valid. We recommend reviewing the signage in the area to ensure compliance with the regulations in the future Vehicle Location and Duration: Our records show that your vehicle entered the car park at 9:xx PM and exited at 10:xx PM, this is dated and time stamped on the photographs attached. This indicates a total duration of 45 minutes in the car park. ALL THE EVIDENCE IS DATE AND TIME STAMPED AS PER PHOTO'S ATTACHED. As per our guidelines, we allow a 10-minute grace period. The PCN was issued because the vehicle exceeded this grace period. The appellant has expressed that there is no evidence of the car being parked there, but our cameras show that the car was in the car park for 57 minutes. The ANPR camera data confirms this. We requested driver details from the DVLA within the legal requirements. Signage and Regulations: We maintain that there are clear entry signs and ample signage throughout the car park, which outline the parking restrictions and grace period. The attached images demonstrate the visibility and clarity of these signs. The keeper was sent in accordance to laws regulating Parking enforcement within non-pofa regulations

    I initially thought I was parked for 10-15 minutes, but thinking back I could have driven out then back in.
