So received this PCN the other day for an incident about 3 months ago. Went to pick up the other half from the train station, wasn’t sure what time she would get there so parked up opposite in the industrial estate area in the evening for 10-15mins from memory, then drove to the pickup point and picked her up. She is the registered keeper of the car, I was driving at the time. Did not realise it was private land and nor did I seen any obvious signage around, as Ive parked there in the past briefly. But my fault and now I know! 

Just to clarify, the approach would be the complain to the landowner initially?

Failing that do the appeal via the parkdubbo link? 

Not seen a PCN like this before, 3 months later they are chasing this, plus no picture of the concern, Select Parking Ltd doesn’t seem as advanced as say Parking Eye with their PCN. Unsure if Select Parking Ltd is a member of the BPA and if that changes anything?

    Easy one to defeat... as long as the unknown drivers identity is not revealed. There is no legal obligation on the known Keeper (the recipient of the Notice to Keeper (NtK) to reveal the identity of the unknown driver and no inference or assumptions can be made.

    The NtK is not compliant with all the requirements of PoFA which means that if the unknowndriver is not identified, they cannot transfer liability for the charge from the unknown driver to the known Keeper.

    Use the following as your appeal. No need to embellish or remove anything from it:


    I am the Keeper of the vehicle and I dispute your 'parking charge'. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    As your Notice to Keeper (NtK) does not fully comply with ALL the requirements of PoFA 2012, you are unable to hold the Keeper of the vehicle liable for the charge. Partial or even substantial compliance is not sufficient. There will be no admission as to who was driving and no inference or assumptions can be drawn. PPC has relied on contract law allegations of breach against the driver only.

    The Keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. PPC have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

    Thank you for the quick reply LDast. Thought this PCN looks a bit ‘casual’ compared to others I’ve seen. 

    Just to confirm, I send the above to Select Parking Ltd as a complaint or appeal to the parkdubbo link?

    It's an appeal and you send it to wherever it tells you to send it on the NtK.

    Just doing the appeal but I cannot complete it without uploading a supporting evidence document?

    Shall I just upload the letter I received from Select Parking Ltd?

    Also, logged into the portal for the appeal and they have seven images of the vehicle/reg.

    Thank you both for you help. Appeal submitted and will await the outcome. I will update this thread as soon as I get a response.
