Here's a thread that predicts (based on over 400 DCB Legal examples) how your case will end. Come back and tell us if yours is the same. Read the first few posts, then check other posts that relate to the parking company involved.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Hello Forumites, the N180 has come in - sent 26th October arrived 2nd November and deadline for sending in 12th November so wanted some advice if you can help me get this right

B: as dad is going away for winter I have put his name added c/o my name and my address - is this OK do you think or should I just put my name there as his name is in the front box on the form
D1: have used the short version to say no to determination without a hearing

Determination without hearing seems to give a disproportionate advantage to the legally represented Claimant, whose entire business is issuing cut and paste parking case paperwork, and using aggressive and misleading tactics to ensure payment of inflated charges. I feel strongly that I need a voice at an attended hearing. I wish to question the Claimant about their evidence, and to expose omissions and any misleading or incorrect evidence or assertion.

E4: Vulnerability - Meditation : Have said Y and stated in comments  Defendant is elderly and requires his daughter be present at mediation to support.

F1: Hearing venue - closest one is Bournemouth but read something somewhere about this not being a good venue ? Advice welcomed can't see any other options nearby

F6: Vulnerability Court : Have said Y and stated in comments Defendant is elderly and requires his daughter to act as lay representative for the court hearing.

    You can't put your name.

Has to be done in his name.

Add a week either side of Dad's flights because he's not going to be available/able to face a hearing days before (or mere days after) strenuous travel.

Surely someone (you?) can check his post once a week while he is away? This is vital.  He can't just not be at home and miss court instructions or he'll lose.  Somebody must collect his post at least weekly.

  • Thanks @Coupon-mad will extend those dates
Do you think it's an issue then to get the comms on this sent to my address? I know we'd talked about briefly at the beginning if I could do that because I was worried about him not checking his post properly.
I can and do go when he's away to check the property but just feeling a bit more anxious about it and wondering if safer to get it sent to mine. But I do understand as its a change of address now half way through so I am guessing this could make it complicated.
Everything else ok to say on the form? Once again huge thanks for help

Up to you.  Whatever feels safer but whatever you do, DON'T allow any possibility of letters going unopened/unseen.

  • Thanks for all help so far- the good news is the mediation appointment came to my email which I put on the N180 - the bad news they've scheduled it for when I am overseas! Trying to reschedule - if anyone has any tips or advice for that session please let me know - am going to prep bullet points from the defence and WIP witness statement but any thoughts welcomed

Yes... offer £0 and it will all be over within minutes. The only obligation is to "attend" the call. It is not part of the judicial process. No judges or lawyers involved. Stop fretting about it.

Why reschedule? Just nominate a family member to reliably take the call and offer nothing on your behalf. 5 minute call.

Say what now?! Why?! None of this is needed.  That's NOT what the first 12 steps coaches you to do with a (complete joke in parking cases) Mediation call.

Thanks all for the advice - I had the call - said no to settlement and made no offer and now can see on MCOL it's been referred to our local court as requested. Assume now I wait for court date - is it normally sent out when that court referral is made - date says 14.1.25 and I checked at Dad's on Wednesday but nothing in the post yet.

MCOL has nothing further to add once they have transferred the case to the local civil court nominated on the N180 he filled in,  no further updates because they are no longer dealing with the case,  the county court are

The county court will post out the court order to him sometime in the next few months,  keep checking his post weekly at least
