Ring them asap and complain about the deletion and ask them where to send the replacement

They do appear to have had IT issues a few times since July
  • @Gr1pr it's odd though McOl seems to have it as filed so hoping its OK if that is showing defence received? Only thing I can think is that they just saved the pdf and deleted the email once they had done that rather than opening the email

You are wasting your time thinking about what might have happened.

Phone the CNBC - number on your Claim Form - and find out what is going on.

No need. Seen this before and it was reported as happening months ago by @troublemaker22 who experienced the same.

The defence is in.  No need to phone. Terrible admin by the CNBC though. Shocking.

  • Hello everyone, so some updates on this one and some advice needed:
My dad had a follow up letter from DCB with the "alleged" NTK's and images. TBH the pics don't show clearly disabled bays - no image on floor or in front of the space just double lines by the looks of it.
I wrote them a letter to say I don't believe the evidence shows infringement and reiterated no NTK ever received, albeit seem to have no problem receiving these legal letters!

DCB have just emailed me to say this:

    WITHOUT PREJUDICE

     Good Afternoon

We write in relation to the above matter.

Our client is prepared to make an offer to potentially conclude this matter. We ask that you call us on 0203 838 7038 before XX/XX/2024 to discuss this further.

What's the best path to take here? I think from what I have read this is quite standard - do I reply and say no thank you on any offer or ask them to share in writing - I really don't want to speak to them - image here for ref not have only blurred cars nothing else

Ignore the letter, as explained in the template defence post by coupon mad
  • @Gr1pr Hi not sure which section of that thread you're referring - I know some of it i.e witness statement for later seems to have disappeared from there so perhaps its missing? Or I have missed it nowhttps://forums.moneysavingexpert.com/discussion/6108153/template-defence-to-adapt-for-all-parking-cases-with-added-admin-dra-costs-edited-in-2024/p1

Removed, from the second post in the newbies sticky thread, not missing from the defence template thread

My point was that the early settlement offer letter from the claimant or their lawyers should be disregarded, ignored

    Its in 7)

    7).
Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire and the usual intimidating template letter saying they 'intend to proceed'. Nothing of interest there. Just file it.

YOU MAY HAVE TO WAIT TWO MONTHS OR SO FOR THE NEXT STEP TO HAPPEN:

Sometimes there are more than one intimidating letters, including the offer of trying to settle the claim early

I didn't mention anything about the witness statement bundle stage that comes later in the process, which is the last sentence in 7)

WS stage has never been in the Template Defence thread.  Only the first 12 steps.
