    Certainly he tells them both of any changes that are required, especially a different address for the service of papers, regardless of age or circumstances, changing details like the correct address doesn't change the claim

    Runs of accessible bays at retail parks almost never have ANY t&cs signs. I've noticed this is true everywhere. Looks like they deliberately target the vulnerable. Evidence pics to prove a lack of t&cs (full) signs in that whole area would be good.

    A person over 80 might be considered vulnerable if he is frail or suffers from long term conditions.

  • Hello Forumites, thanks for all help so far - I am just getting ready to email the defence letter  to ClaimResponses.CNBC@justice.gov.uk
    I just wanted to check - do I need to complete the form originally supplied with the claim form where you have to tick some boxes on the form and sign or just send the pdf letter of defence.

    Items 4, 5 and 6 on that list seem quite clear to me.

    Do you know whether there are signs along these disabled bays that are fully readable from the driver’s seat without having to get out ? ( Including the small print)  . 

    This is a mandatory requirement under the BPA Code of Practice .

  • @Bazarius thank you - challenge I have is the parking agent has now changed so no evidence of what it looked like before - there's been a full car park revamp! 
    @KeithP I did look at steps but just wanted to double check - this is very important to me and my dad so am probably overthinking it but do appreciate all the help here.

    I have received the following response to my email - is this the normal email reply to say they will process in 10 days or should it be more than that at this stage

    When sending us documents please ensure you comply with the Practice Direction 5B

     Documents not complying will not be accepted, in particular if it is over 10MB or 25 printed pages in size.

    I agree ! And these car parks are supposedly get audited by the BPA …. 

  • URGENT HELP! After sending the defence via email and receiving the automated response well ahead of deadline see below.
     


    I then got this today? which is past the deadline -any advice? I just tried to resend and it said undeliverable?



  • Then I have just checked MCOL and it says this? which seems to show they have the defence - I am very confused
