    The way this works is the land owner gets paid for parking through the Parking Eye machines which are provided FOC.
    Parking Eye get the money from mistakes such as yours, not from the pay machines.
    So the landowner got nothing, he will gain nothing at all from letting you off.
    Parking Eye are ecstatic they want their dosh from their scam.
    The landowner probably can cancel so many PCN's per month but yours isn't going to be one, and PE couldn't care less they are infused with nasty greed.
    You are now at an impasse that only a judge can decide on hopefully with a balanced fair outcome.

    POPLA codes last till day 33 so if you have exhausted PLAN A then you still have time this week to do POPLA ... ONLY try it if you have a case they'll listen to (such as photos of broken PDT machines or whatever went wrong).

    If you don't have evidence, don't try POPLA.

    Ignore ParkingEye if you lose.

    Defend if you get a small claim.

    Thanks @Coupon-mad.
    I have emailed Parking Eye again, they may not reply before day 33, and of course may well say they have already rejected my appeal. I have doubts as to whether anyone actually read the first one. 
    Assuming they threaten legal action, do I have a POFA defence? To me their letter appears to have no invitation to pay, but it looks like the POFA-compliant one in your collection. 
    This is all new to me...

    Court is judge Bingo 

    The court may well conclude that you were the driver, unless you reject it by stating that you were not the driver, under oath. ,!  POFA is no defence for a driver , never has been , but in post 1 you stated that you were not the driver 

    The judge may well conclude that the Claimant has tried to comply with POFA, so they may decide that the PCN is enforceable against the defendant, that money is owed by the defendant, even if they were not the driver 

    The judge must decide if the alleged breach occurred, if the signs conveyed the contract sufficiently, if the driver is liable by contract, if the claim succeeds and if so, how much is owed by the defendant to the Claimant 

    So there is no definitive response to your query, other than, possibly, in the correct court with a clued up judge 

    Its new to most of us, I have never had a private PCN or court claim, but I read a lot on forums like this one 

    Parking companies issue over 10 million PCNs per annum, so its new to most people

    I list that NTK as being POFA compliant because it pretty much is spot-on.  If it is missing an express 'invitation to pay' then I feel that a Judge would consider it implied.

    Dear Sir / Madam, Thank you for your correspondence in relation to the Parking Charge incurred on xx July 2024 at xxxx at Wye Valley Visitor Centre, Ross-on-Wye car park. Your appeal was rejected and a POPLA verification code was provided. This gave you 28 days to appeal to POPLA. Unfortunately, your time to appeal has now expired. Parkingeye are therefore unable to assist you via our appeals process. We request payment is made within 14 days. Upon receipt of this payment the matter will  be closed and you will receive no further correspondence from Parkingeye.     Not addressing my issue about the void receipt, but more surprisingly not threatening me if I don't hurry up and pay and not saying how much to pay.

  • I've been reading this thread with interest as I am in the same position. 

    The driver of my vehicle parked at Wye Valley a week or so later and also fell foul of the faulty payment machine, which produced a "void" receipt.

    My PCN PoFA wording is identical. 

    I have received the POPLA code and PE appeal rejection today (16th Sept) 

    @doomswell Can I please ask if you followed the advice from @Coupon-mad to offer to pay PE £10 to cover costs, and if so what was the outcome?

    Or did you continue to pursue the POPLA appeal route?

    DO complain to the owners of the butterfly zoo even though they won't listen. Put a bad review on TripAdvisor & warn people to stay away.

    Come back if you get a court claim, when you will need your own thread. Perfectly winnable in court but not at useless POPLA.

    Bad reviews on Tripadvisor is a great way to get owners to take responsibility for the parking predators they have engaged.

    As you can see from this tread - you are not alone - it's a shame that some people have paid though...
