Yes I do agree with you and what you suggest makes common sense...Grumpy_chap said:
However you feel, a full refund is highly unlikely. Ultimately, you have had the use of a car for seven months and covered miles in that car and had the service on that car carried out by the dealer. The nearest a "full refund" would get would be after some deduction for the value of the beneficial use you have received to date.Ehi said:
OUTCOME: A full refund and an apology for misleading me.
From a practical perspective, the brand new car that you want to have is on a long lead time, so if you were to receive a "full refund" you also return the car you have currently at the same time. That leaves you with no car to use and no car on order. Will you end up making another interim purchase that is not what you want again?
As an offset to the "full refund", you can sell the car you have purchased (and settle the finance) at any time. How would the amount you could simply sell the car for compare with return for a "full refund" (after the deduction for use)?
...but, if it was the other way around and I was at the receiving end of the stick. These companies would have ruthlessly dealt with me. Imagine. I missed a direct debit payment. It would have been on my record for 6 years and not just I won't be able to get decent credit. Every provider would up their charges
Most importantly, this case. Is a case of blatant deception and using a corporate name to bully me. So they too should bear the brunt. After seeking advice. I am told I could get full compensation, so hopefully that'smy goal
If it's the case legally. Then I won't loose sleep
Is there any other thing I would be missing ?
Can those who told you ought to get full compensation not advise you?2 -
I am told. Full compensation of what is due, based on depreciation PCP cost calculationDE_612183 said:@Ehi - are you trying to get full compensation for a car you have been driving around in for months?
Are you expecting to end up with a free car?
Because thats what it sounds like to me.
With regards the service charges, a complete refund. As I was told it won't need a service in 12 months. Which was false and honestly not my fault0 -
Why didn't you confirm the order during the intervening 7 months when the production lead time shortened?Hoenir said:He said I cant order due to backlog and can only pre-order. Which I then did.
What were the terms of the pre-order ? Did this have to confirmed into an actual order at some point, i.e. complete specification determined and reservation deposit paid.0 -
It is unclear what you actually mean by the phrase "full compensation" so no-one can comment as to whether your stance is reasonable or not. You do need to be clear in what you expect to achieve and be able to communicate that concisely as a request when speaking with the garage.Ehi said:I am told. The issue about the refund for the service seems rather unlikely from what I understand. Whatever the "noise" around it being temporary and only until a brand new car was available, you purchased a used car and covered X miles over a period of 7 months. That triggered a mileage / time-based service interval requirement for the car to be serviced. Had you purchased any other used car, or even a brand new car, the service interval based on time and mileage would be been along in any case.
How many miles have you covered in the car in the 7 months you owned it?
I am actually unclear what you paid for the service as you say "refused to pay" but also they "refused to refund":
The garage cannot refund you for the service if you did not pay for the service.Ehi said:
I refused to pay the service charge, insisting it be waived, but since it was part of the quote, they refused to refund it.0 -
Don't bother asking for an apology. Even if one is offered it will be insincere.
(Speaking as one who when an error had occurred would write to the affected person and end the letter " I would apologise for the error and any inconvenience caused", but to me it was just another part of the day's workload)If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales1 -
You say you were told it would not need its annual service for 12 months.
They later realised they had made a mistake and service actually due earlier than they had said so they carried out service at 7 months (so next service due 12 months from then?) and refunded 50% of service charge.
That does not sound unfair or unreasonable.0 -
The OP is not getting the answers he wants, folks.2

When people want an apology it always makes me cringe a bit. If you get one, it will have no meaning behind it and by someone that probably really doesn't care.

if I take the OP's original post at face value it seems as they they were scammed - and I used the word advisedly - into taking out a finance agreement for a car they did not want. In fact I would go as far as to say I have never heard of anything so blatently deceptive as this.
that being so I would definitely go to the finance company and demand the cancellation of the contract, return of all.payments made and return of the car to.the garage1
