Mediation is about agreeing a compromise
You offer £0 , the claimant wants full payment, so impasse, no agreement so tell the mediator that you want it heard in court by a judge, politely end the call, wait for further instructions from the court, dont miss deadlines
( I have no idea why you need to reread your defence, but yes you are adamant about not paying anything. )
The mediation call is probably 10 minutes at most
Several victims on here have been through it within the last couple of months2 -
Ok thank you for your replies coupon-mad and Gr1pr
Gr1pr I was going to re read my defence to fully understand things? There were things included in there like the Beavis case etc which I copied and pasted but know nothing about
I am really grateful for this forum and your replies, I know I wouldn't have come this far without the forum!0 -
But the mediator isn't going to go into the case details, they just want to try to settle the matter with offers, counter offers etc. ( Its an independent mediator, not a legally qualified judge. )
You will be expected to know your case in a proper court hearing with a judge presiding2 -

Hi All
Had my mediation call today. When I said to the mediator that I am not willing to pay anything, he said that means that I am withdrawing from mediation and he would make this known to court. Also reminded me that the courts prefer a settlement. He said they have pictures of my car out of the bay and that they would use that in court as evidence which will be a lot more weighty than my words stating that the lines are unclear. I said to him that from an image far away, lines are visible more than they are when you're on the ground but he said that the picture will be used in court.
He said I can put an offer to them instead of withdrawing. Should I still stick to saying £0. I am feeling worried as he said he will make it known to the court that I have withdrawn from mediation which doesn't look good on me right?2 -
I am just worried as I know mediation has recently become compulsory so I wonder if any of their rules have changed regarding not reaching a settlement!1

The mediator is supposed to be neutral!3

OMG is this another bad mediator or the same one. You participated in the compulsory mediation it is NOT compulsory you settle or offer a monetary figure. You must raise concerns about this mediator's practice.
Small Claims Mediation ServiceIf you have any complaints or issues to raise about the Mediation ServiceEmail: scmreferrals@justice.gov.ukTell SCM exactly what was said, how distressing you found the appt which has now left you feeling worried and pressurised into settling.2 -
As above - perhaps also enquire if these mediation calls are automatically recorded (I have made a couple of posts on other threads suggesting that the Defendant record their call with the mediator).
