Did you instruct the PPC and their agent to "erase" your old data and replace it with your current address for service? Did you specifically use the word "erase" that has a specific meaning where data handling is concerned.

I asked them to rectify my address and to delete the old address. I didn't say erase
Rectifying and deleting are not the same as erasing. If you did not use that specific word and request your data be updated with your current address for service, I suggest you do so again, ensuring to use the word "erase."

I've asked Britannia Parking Group to do this and they have not acknowledged my request. They have only responded by saying that I should have updated the DVLA with my address. They also said the PCN has been passed to DCBL and I should contact them

So you now complain to the BPA that Britannia breached the BPA CoP and refused to pause debt recovery and reissue the PCN that they know was never served.

    Same as here:
    https://forums.moneysavingexpert.com/discussion/6528462/bw-legal/p4

They also seem to have refused to update the address but to cover that, just send DCB an email telling THEM to erase the old address and to 'jog on' because they will never litigate in Scotland.

DO NOT SAY WHO WAS DRIVING.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you. Seems like both of them are ignoring their own data protection policy. Will complain to BPA.

If the PCN is reissued with my new address does that mean the 5 years restart again?

Also I found this on the DCBL website under CSA code of practice.

ab. Ensure that they take into account a customer’s domicile
and the law applicable to the agreement underlying the
    debt.

    Can I use this?

    No.  Nothing restarts it.

    Yes. Good find!

  • Great! I'm gonna wait for them to respond to my last email before I hit them with this.
  • DCBL have emailed me back with the following email. No mention of rectifying and erasing my data or answering my question about the £70 fee

    Dear Sirs,

    Your ref xxxxxxxxxx

You can forget the idea of a chat with you. No clued-up consumer victim of rogue PPCs would do that.

    You must now:

    - answer my concerns about the £70 costs/debt recovery fee and why your clients are seemingly swerving VAT due to convoluted accounting whereby victims pay fees and effectively the consumer pays the VAT element, too. Explain?  I will report you to HMRC.

    - rectify the address to the new one only, and erase my old address data. Failure to confirm this will see you reported to the ICO and the CSA which requires in its Code of Practice:

"Ensure that they take into account a customer’s domicile and the law applicable to the agreement underlying the debt."

I stay in Scotland. Jog on.

    Yours faithfully

DCBL have always been funny about updating address , DCB Legal no issue ,  same with DRP and most parking firms but DCBL seem to think they are on a different planet
