Just to update this thread,
Claim defence logged - the claim was quite a joke to be honest. Asking the court to fine the defendant for breaching the bylaws ( yes really) "to seek the maximum level 3 fine of the breach of the byelaw which is a maximum of £1000" - In the county court come on you could do better then that
The defence was logged , using the money claim system (not what parking companies use - its far better imho)
Defendant informed the claimant and the court of a new address as they had moved which was many miles away from Nottingham (unfortunately for the claimant) - He really wasn't very happy with that
Claim was mistakenly allocated to the defendants old local court- swift email on allocation pointing out the relevant CPR Rules - then allocated to correct court.
Given the 3 hour drive for the claimant (they dont use external reps) they folded by not paying the hearing fee.

Hey all
Just need a bit of advice. Car got clamped by private company working on behalf of Nottingham Trams (NET) when we parked at forest park and ride. We didn’t realise the signage saying you had to go on tram to town centre (we walked into town and got tram back)
I paid the £140 to get the clamp removed, even after arguing we had purchased a tram ticket that day but decided to walk due to the nice weather!
I contacted bank to do a chargeback for transaction and I received my £140 back, and now I have received this letter.
I know I'm in wrong for doing that but can they proceed with court and have sufficient evidence to prosecute ? I tried to contact them but no reply, and it’s odd they want a bank transfer but not reference number?Very nicely done!ChirpyChicken said:Just to update this thread,

Shame
Sounds like they relied on intimidation & the distinct chance of default CCJs and didn't know what they're doing.

Late lurker here. May I ask what bank you (or anybody else reading this that has done a chargeback) is with?caspre12 said:

I ask because I'm with Nationwide and they were pretty damn unhelpful to be honest. Will only take it any further for me if I get a crime reference number 🤨, which is not really a route I want to go down.
Just want my money back essentially. Happy to deal with any of the silliness that follows as regards their BS legal/court threats...

Try it with Action Fraud (yes really) get a reference number from logging that online and give that to NW!3

I've never had anything to do with them, but I'll certainly look into that now you've suggested it. I guess my query would be that as they're government based are they likely to just shut me down as it's ultimately against Nottingham council who are obviously also government based.ChirpyChicken said:Try it with Action Fraud (yes really) get a reference number from logging that online and give that to NW!
Guess I was just hoping to hear from some other people who've done chargebacks with their bank. Perhaps I was at fault in the way I described it to them (said I'd made the payment under duress, which I felt was pretty accurate), but after a few minutes on hold they just weren't interested, barring a crime ref number.0 -
And for the record, I have no great defence. I simply parked and walked both ways. Call it naivety, but I hadn't parked there in years and thought nothing negative would come of doing so...0

https://www.actionfraud.police.uk/ log it there under "scam" or other
Get the reference number
Ring NW back,
Come back to us if it succeeds and you get any daft letters from CPS Midlands (they are not a very bright bunch)

Apologies, I wasn't referring to the chargeback being to do with the council but more the fact that Action Fraud are government based much like Nottingham council and as CPS are supported by said council it'd probably be in AF's interests not to support any claims.Coupon-mad said:0 -
Thank you. If I do end up succeeding I certainly will do.ChirpyChicken said:https://www.actionfraud.police.uk/ log it there under "scam" or other

Will also be informing CPS too, as the S***house in me wants to do nothing more than gloat at the vermin to be honest. If there's one thing I hate it's scum using some loosely veiled front of legitimacy to extort from everyday people!2
