    Just the usual guff about how if I do proceed in zero settlement, it will go to court and I could end up being liable for far more than the few hundred that is being claimed, and that I would need to prove and defend my case robustly to prove innocence to persuade the court. I towed the line that these are bogus claims from bulk litigators that are non compliant with the codes of practice, as per my defence, and that the court would be wise to strike it out as would otherwise be wasting increasingly precious court time. She quickly backed down and said there was no point in continuing the call and that was that! I got the sense that she has fielded quite a few similar calls!

    This included two lies by the Mediator:

    1.  You don't risk 'far higher costs' than the few hundred in the claim.  This is plain wrong.

    2.  It's not your burden to 'prove innocence'! Surely the Mediator didn't use that phrase?!

    I did consider arguing on both points but I wanted to get off the call as soon as it started! On the 2nd point, I might well be paraphrasing, but it was along the lines of proving my case, why I was not in the wrong, and why I did not deserve to pay anything etc. She did come across a bit Judge Judy tbh!

    Sounds like this mediator was well out of order. Not her role to scare one party into thinking they could be liable for higher costs should it go to court. Was she a bad apple or is the mediation service adopting other tactics to achieve results. If their settlement numbers are low it's likely the mediation service will be withdrawn.

    Absolutely, Mediation is supposed to be neutral!

     Very good!

    This is a thread for @Le_Kirk to see, as that Order can be added to the 'judgments' link.

    And in view of the rubbish that the Mediator said to scare and mislead you, followed by this from a Judge who knows the score about scam parking claims wasting court resources, please can you fit in time before Friday to do the Enquiry below and show the CJC a word doc of your documents/orders, concentrating on how inappropriate naive (Claimant-supporting) Mediators are for parking cases?

    PLEASE tell 
    the full story of this saga to the CJC this week.  You can only attach a Word document to submit evidence but you can put images on a Doc.

    The main point to make is that the CJC and MoJ MUST step in and stop parking firms from ruining good people's lives and peace of mind, putting their credit rating at risk, having used Particulars of Claim so woeful that a Judge just spots the issues in minutes but had to take precious time to read their rubbish and issue special Directions.

    Ask why court time is being so much wasted on propping up 'scam' (almost always discontinued or lost by the Claimants) claims from PPCs?

    Enquiry closes on Friday so this is urgent.

    This WILL make a difference.
