Does that mean everything in my first appeal was bs or??
Well it was BS. You paid for 3 hours and stayed over 4 hours.

There is also a lot of pictures attached of the signage at the car park and some random letters I assume justifying the ‘contract’ they have with the landowner. Can include if needed but it’s a lot of screenshots

So find anything in that evidence pack that is a problem for them, plus anything else that bolsters your Popla appeal submission, so failures by them and errors and omissions that bolster your case

You have 6 days to copy and paste your comments into the Popla reply box

    Dear POPLA,

    My comments are:

    - None of the (blurry) signage photos are date-stamped.  There is no evidence of which signs were, or were not, in situ in 2024.

    - None of the signs in evidence show a readable term about breach.  And no readable term about £100 PCN.

    - (whatever your appeal point was about POFA, reiterate it briefly, assuming you never admitted to driving. I didn't read back).

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Is it usual for it to take this long? Have had no response/email from popla since submitting my evidence except to confirm they received and are reviewing it

Yes, they are behind at the moment. Probably due to staff holidays.

Finally got a response. Not successful.

frankly I think I got bad advice here. No continuity of advice and random people saying do different stuff.

    Popla response includes the following:

I acknowledge that the appellant has made comments about the signage and the Protection of Freedoms Act 2012 (PoFA) in response to the operator’s evidence. However, I cannot consider this as it is a new ground of appeal. POPLA can only consider grounds of appeal raised within the initial submission of the appeal to POPLA. The comments section is not a platform to raise new grounds, but to extend commentary on those issues already raised.”

I did try to highlight this before submitting my appeal that the help here is random and no real strategy has been provided. That I felt like a blind person taking directions from multiple people at once who won’t explain the destination.

So I guess now it’s pay the fine or deal with debt letters for the next few years right? Gee thanks wish one of you gurus said that before I started copying and pasting things as if there was gonna be any kind of strategy behind the seemingly meaningless stuff I was advised to copy and paste
