    Just to give an update - I sent the above in an email to PE Ltd (cc DCBL) on Friday 14/06, I still hve not heard back and I want to be fair, so if I hear nothing by 4pm today then I will make some updates on the N244 form and my witness statement and draft order.

    I cannot tell you how overwhelmed I was by all this at the start and my husband was going to contact them to make a payment plan (lucky someone told me to come to this forum).  I am so glad I found this forum and saw how many others this had happened to.

  • Today I received this letter from DCBL. 🤣

    Funny how I asked them/PE Ltd to reply to my correspondence by Tuesday 18/06 and I still have not heard from them.

    In all seriousness do I need to anything with this or just ignore?

    Remember that's from a different arm of the group. It's not "them" you emailed (hopefully you emailed DCB LEGAL not DCB Ltd) but you could include the DCB Ltd letters as an extra exhibit when you apply next week.

    If DCB Legal don't reply by midweek.

    Main exhibits are CEL v Chan and proof of moving and that you were 'there to be found' plus the BPA Code of Practice clause which makes address checks pre-action mandatory.

    Best recent examples of the WS and Draft Order to go with a N244 CCJ set aside application are in the thread by @Zbubuman and you are now (importantly) 4 months past the claim filing date with no claim ever served, so ALL arguments & case law seen in his thread apply to yours.

    @Coupon-mad I sent the email to enforcement@parkingeye (Claimant solicitor: PARKING EYE LTD) as you previously suggested and cc'd collections@dcbltd.com in as I couldn't find a different email address.

    I have already created the WS and Draft Order using the one in the thread by @Zbubuman in preparation for me not hearing back from them.

    @Coupon-mad.  I have checked my junk folder and they have definitely not responded.  I was thinking of emailing PE Ltd (cc - DCB Limited) one final time the following but just wanted to get your thoughts on this and if I should:

    Dears Sirs,

    I am reaching out for the final time to invite the Claimant to join with me in an application to set aside the judgment and dismiss the claim, with the Claimant paying the court fee and no order as to costs.

    Please respond to the offer below as soon as possible so that, if the offer is acceptable to the Claimant, we can work together to right the wrong that the Claimant has done to me.

    I am once again willing to defer making a unilateral application to set aside the judgment until 4pm on 26th June 2024. If a joint application has not been made by that time, I intend to apply to the Court unilaterally for an order setting the judgment aside, striking out the particulars of the claim, dismissing the claim and awarding costs against the Claimant on a full indemnity basis.

    Please respond by immediate return.

    After 5 o'clock on a Saturday afternoon, you are proposing to send an email to PE giving them until 4pm tomorrow, Sunday 23rd June, to respond.

    Just a guess, but I don't think you'll get a reply in that timescale.

    Also noticed - you appear to have just published you full name.

    Thanks for noticing the wrong date and the mistake about my name 😱 (I have amended accordingly) I want to email them tomorrow for a final time following on from an email I sent them on 14th June.
