  • I have paid the £303 now and just wanted to know if anyone could help me with the last few questions I had before I submitted everything:

    1. Are the details correct for the N244?

    2. Are the details for the Draft Order correct?

    3. At the end of my WS after my signature – can I make a list out of all the Exhibit numbers I am using within the WS e.g.:

    EXHIBIT-BX-01 - Virgin Media Bill
    EXHIBIT-BX-02 - Credit Report

    4. Does it matter that I previously went onto PE portal and saw what the parking charge was for but never received any letters nor the paperwork for the CCJ?  I have mentioned this in my WS and just don’t want it to impact my claim to have it set aside.

Many thanks, really appreciate any help.  :)

@Le_Kirk - sorry is this what you are referring to?  I don't quite understand what you mean.

Where you have a fixed date such as the date of the original judgment, you put that in.  The only reason for leaving blank dates is for the judge to fill in at or after the hearing.
  • I submitted everything on 2nd July. What is the process now that everything has been submitted and how long does it take before they get back to you?

I also just spoke to a lady who deals with the removal of CCJ's (an old friend gave her my number as they thought she could potentially help me) and she said that more than likely I won't win against PE Ltd and my best bet is to cancel the £303 I paid and to rather do a Consent Order through them.  She says these parking firms get away with having to only check once with the DVLA for an address and that the judge will most likely be on their side.  What are your thoughts on this please?

    She's completely wrong.

Please re-read the case law about improperly served claims that's in your Witness Statement.  Your submission already covers this.

@Coupon-mad - thank you.  Do you by any chance know how long it is before you hear back from the court about the next steps/process.  I submitted everything on 2 July and have not heard anything since then.

If the case hasn't yet been allocated to your local court, you should ring the CNBC and ask why they haven't fast-tracked and allocated your application yet.

After loads of phone calls and chasing up as they just kept saying they had no received any of my emails, I got a letter in the post "Notice of Hearing of Application"

Does anyone know what that involves and what information I should take and what prepartion should I do.  The hearing is in just over a weeks time. 30 minutes has been given for the hearing.

    Many thanks

Yes you should read some completed CCJ set aside cases to read how their hearings went.

Search the forum for something like:

CCJ successfully set aside Judge hearing
