AET for Light Touch £1437 net or gross

Having transferred from WTC I had assumed that UC was also based on gross income but the month 1 payment shows me it is based on net.
Because of how my pension is calculated, whilst my gross is comfortably over the threshold, £75 PAYE and £215 NI bring it it below the AET. Does this mean as a couple we will not be on light touch? I am unable to reduce my pension contributions this tax year.

Hmm - appears that whilst the UC payment is based on NET earnings, AET is based on gross so I may be OK?I think....1

UC payments are calculated on net pay but AET is based on gross pay. This is because AET is calculated by reference to both NMW and to x amount of hours worked (apologies, I've forgotten what those hours are). This will always produce a gross figure for AET. To do otherwise (ie base AET on net wages) would penalise people such as yourself who have other sources of income such as a works pension.

The one (not so common) exception appears to be 'payroll giving', which according to the regulations would seem to be deducted from earnings for AET purposes.1

Is there a complaints procedure?So you are making pension contributions to a SIPP and UC are failing to take these into account?If they've made a decision (incorrectly) not to take them into account, you would request a Mandatory Reconsideration.If they are simply failing to respond on the topic and have not said that they cannot deduct them, then there is an online complaints form below which will go to the complaints resolution team:1 -

If so, have a look at the part towards the bottom that expands out and says If you think we've made a mistake or want to appeal.By paying you (even if it's £0), they have made a decision about your entitlement, so you can request a Mandatory Reconsideration (MR) and get the ball rolling to resolve. This will then go to a qualified Decision Maker, who should immediately identify and resolve the issue - it's not like this is new to them any more.Please tag me on any replay if you want me to look/respond as I'm not otherwise getting to check posts regularly atm.

Assuming they have, all you can do is wait for that to happen and for the outcome. Ask when they referred for MR. Unfortunately, waits of 3 months or more are not uncommon.Once you deem an unreasonable amount of time has lapsed, you can make an official complaint online, or you can contact your MP to hurry the process along, but an MR needs to happen as the next stage in the process.
