Hi all.

Firstly thank you for all the information, contacts, letters, templates on this forum and the individuals who go through all the time and trouble of helping others. Like myself!  Ive not used any templates etc yet but will do as advised .. Thank you.

 

Secondly…..

Ive made a few notes and tried to have a look at what I think are similar. But still a little unsure.

 

So I  would be very grateful if someone could help clarify my situation.

August  2023 - Moved house : 

I moved house in August 2023

Updated most addresses but missed the logbook (V5C)!   Which I’ve done right now online, after suddenly receiving this Notice of Debt Recovery form DCBL (Direct Collection Bailiffs Ltd)

March 2024,

I parked in a small, car park, at the back of a business.   

The person I had gone to visit, around the corner, from a different business, told me this was a public park. 

Ticket machine in car park. I put in car reg details and paid for an hour or two.

I cant remember if I paid £1.00 or 2.00 for about an hour or two.

That was a few months back and since I had paid, I didn’t think anything of it!

June 2024 :

Have, suddenly, received a “Notice of Debt Recovery – Unpaid Parking Charge”  and unbelievably, not only out of nowhere!  But also for £170.00! To be paid in 14 Days.

Yet it is dated 4 days ago and I received it today, so  4 days later.

Apparently a member of BPA.

 

Up till this point,

I have not received anything before this.

I have not made any contact with anyone as yet.

I cant remember if I paid for £1.00 or £2.00

 

Would be very grateful, for any help advice etc anyone could give.

    Start by reading the sticky Announcement for NEWBIES. The original PCN would have gone to the keeper's old address because that is what was held by the DVLA at the material time.

    Debt collectors are powerless and can safely be ignored. However, CEL will have used DCB Ltd to do a soft trace that costs a few pence, not £70, to find the keeper.

    You should send a rectification notice to the DPO of CEL instructing them to erase your old data and replace it with your current address for service. Make sure you use the word I have highlighted.
    Because CEL have your old address, that is where they will send a court claim if you don't do the rectification notice, especially now they know you no longer live there.

    Plan A is always a complaint to the landowner, and it is never too late to do so. Other than that, and telling CEL the keeper's new address for service, and reading up on what to do if you receive a LoC/LBC or a court claim, you should go into ignore mode.

    Do not under any circumstances reveal the driver's identity in any communication.

    Yes, get the old address erased. ONLY do that; it's all you need to do for now.  You can't appeal but don't worry about that.

    When you get the LBC from DCB Legal, send the reply shown in the NEWBIES thread.

    When you get a court claim (NOT SCARY, AND NO RISK OF A CCJ AS LONG AS YOU FOLLOW OUR ADVICE) that's when you defend and it will be 'scam over'.

    From your replies regarding “Identity”, a question/concern I have popped into my head

     

    IDENTITY –

    This Notice of Debt Recovery  - Unpaid parking charge £170.00”   I’ve received from DCBL – Direct collection Bailiffs Ltd for Civil Enforcement Ltd, already has my name & address on this (1st contact I’ve received from anyone of them). 

    So when I email them, (Landowner and Rectification of Address) should I be concerned about this?

    Just wondering what to put or not put into email since they have these details.

     

    I.e

     1.  Contact Land owner  - 

    As a plan A, when I contact Land owner, do I disclose my name address should they ask me?

     

    2.  Rectification of Address  -  I have found emails of both

    DCBL (a general Info @ address)  & CEL (dataprotection@........).

     When I make contact to have my address changed and all else “erased”, 

    again will it make a difference now they they already have my name and address?  

     

     

    (Car park had cameras high up on wall. I parked and fully, paid for an hour or two, with whatever the small fee was in that car park)..

    Yes. The difference between risking getting a CCJ next year and not getting a CCJ.

    It is the ONE THING you MUST do!

    I don't think you understand what DCB do when they hold a choice of 2 addresses. Guess which one the legal team will send a court claim to...?

    100% want to avoid all this.. and am ready to email them to change address etc. 
     
    But what i meant was that , before i do, I just wanted to make sure im understanding it clearly for myself and appreciate your help on this too.

    I know we said avoid giving identity, but im just wondering how i can avoid it if they already have name, address, and email.

    So will this be a problem for me,  that they will then have my email address, as well as already having my name address too?
    Or too late to worry about identity now and im over thinking it?!

    It doesn't matter what information they already have about the keeper's identity. What is important is that you tell them to erase what they already have, and replace it with your new and current details.
