I wonder just how many miles have been put on the van since it was sold by OP.
Might be a good question to pose in court if given chance.Life in the slow lane3 -
Good luck Mandy.
I hope you win and also get expenses.A man walked into a car showroom.
He said to the salesman, “My wife would like to talk to you about the Volkswagen Golf in the showroom window.”
Salesman said, “We haven't got a Volkswagen Golf in the showroom window.”
The man replied, “You have now mate".1 -
I have been out all afternoon walking my little dog trying to keep my mind off tomorrow. Just came on here and I'm honestly overwhelmed by the support from all of you lovely people. Yes, I'm nervous and I'm worried how I'll pay if I lose but I know I have been truthful throughout and win or lose I can sleep knowing that. I'll come back tomorrow and let you know the outcome. I literally feel sick at the minute😔 thank you x17

Whatever the outcome, you are doing something quite incredible.
You're standing up and fighting what you believe is right.
That's no mean feat and everyone on here knows that.
Best of luck, fingers are all crossed.5 -
Thoughts with you today Mandy, I hope I'd have the strength to do what you're doing0

Hi all.
Well I got to the court in good time and sat with my witness who was with me on day of van sale. At 10:15 we were called into the court and there was just myself, my witness and the judge. The judge then told us the claimant has not been able to attend due to being stuck on isle of man because of the recent storms. No idea how much notice he gave the court but I had no notice at all. The judge asked me if it would be a huge problem to postpone to a future date as in cases like this he'd like to hear from both parties in person. I said it wouldn't bother me. So it could be another couple of months. Disappointed. x15 -
Gutted for you, been watching this thread all morning for an update.
Of course this could just mean they actually won't bother to turn up at all ! They just tried to bully you into giving them money back.
Stuck on the Isle of Man in their camper van !.3 -
Make sure you've noted down your costs for attending the aborted hearing (and those of your witness).
PS - did you note on your defence documentation/acknowledgment of service that you'd be calling a witness to attend the hearing? If no witness was expected by the other party or the judge then the judge may disqualify them from speaking.Jenni x5 -
