The para about PoFA 4(5) as far as I can see, applies s long as the driver is also the keeper. It is the keeper part that applies. It would not be relevant if the defendant was the driver but not the keeper.0

Para 4 only works in a case where the keeper wasn't driving. The POFA means nothing to an admitted driver as you admit in 5.
