Hi all, just after a little advice.
I'm currently at mediation stage next week. I'm looking to book a holiday in April for a week but have already sent my directions questionnaire, is there any way of asking or resending the N180 form with the new dates that I won't be available before the court date is set?
Yes of course you must just update it.

You can download one from the Internet. Put all your dates into that and forward to the allocated court, with a covering note asking them to replace the original with the revised one.
...remembering of course to send a copy to the Claimant.   :)

Would I be correct in thinking that when a parking site is for PERMIT HOLDERS ONLY. There would have been no commercial offer to park and no contract could have been formed, and they could only pursue me for trespassing?

    Short answer... probably.

This court order handily puts such a claim on the spot and is a "have you stopped hitting your wife?" approach from a clued up judge:

Others have succeeded with the doctrine of impossibility. If the sign only offers parking to a permit holder and the o/p cannot in any way acquire a permit, then he cannot perform the contract...

    Hi all,

Just an update on my claim from CEL, little bit of an odd one.
Received an email from courts with attachment saying the claim has been struck out due to the Claimant not paying the fee. However I haven't received any correspondence from the court before this giving their directions like when my Witness statement was required, really strange.

Would it be worth checking with the courts again, as it all seems a little odd?

Yes I would, just in case they've muddled up two cases by mistake. If you never heard about a hearing date yet, how can a hearing fee have been due?

They have sent the court order as struck out, and it's a multiple PCN case. Very very odd.

The local court requested the claimant to send the claim form as they hadn't received it, I suspect they sent the form to the local court without the fee.

Contacted the local court via email and they've confirmed the case stands struck out.

Sounds like a problem for their solicitors if they want to attempt to reinstate the case.

    Brilliant! Well done.

Keep ALL paperwork for the rest of the year just in case there are objections going in from CEL as we speak, which you wouldn't know about yet. But ... as it stands:

ANOTHER CEL ONE BITES THE DUST!

By the way, when I re-read your OP I was confused. CEL were chasing PCNs that they'd already litigated, and when you called them out they cancelled them!

I assume this last batch were different PCNs? Are you free of CEL PCNs now?
