Mitigation? What exactly is it? Might go into your facts section but depends.
Our reasons for the (20 minute) overstay: excessive time taken to actually pay at one end; our daughter being moved from A&E (after being there for 24 hours) to the ward at the other - car parking not being top of the agenda when your daughter's being admitted to hospital.
Yep those can both go into your facts paragraph within the Template Defence.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Well, I filed my defence. Seriously, it was tight; a 3 hour delay at airport gave me the breathing space; I've genuinely been off grid for a month. Cocked up my N180; I misread F3: "how many witnesses including yourself...". Stupidly worded; I said 'none', but I'm hardly going to show up and be silent! I've emailed the N180 team and Claimant, hopefully it's not too grave an error.

Mediation now mandatory, which will have to be in the next month or I cannot attend. I have made this clear on the form.

The mediation is a phone call, so you can "attend" anywhere in the world as long as you have a phone and a signal. It is a 5 minute affair where you offer £0 and that is the end of it

There's the rub. I will be largely off-grid, on the other side of the world, from October 2nd.

If you are going to keep putting obstacles in the way, then clearly your best option is just to pay them what they are demanding.

You need to get your priorities in order.

Nobody is ever completely "off grid" if they don't want to be. "Other side of the world" is not a barrier to communication. If it can be done from "out of this world", then it can certainly be done from any "side of this world"... if you want.

I think I know my situation better than you do. Of course, I *could* hike down out of the mountains, find signal somewhere, waste a day to attend a call at 3am my time. But I probably won't.

What, so should I just cancel my 4 months away to make myself available for a mediation call at which I will offer them nothing? That's my priority now?

That's not what I said. I wrote nothing about cancelling anything.

If your priorities mean that you won't/can't make that phone call, then simply pay up. Job done.

Right. So I'm 'putting obstacles in the way' instead of making fighting CarParkCo my top priority.

I'll be hiking from one end of New Zealand to the other. It's a civilised country, but our day is their night, and much of it is wilderness. I just don't know where I'll be at any given time. Not your problem, but I don't really get your attitude.
