So, the Claimant (Car Park Securities) failed to attend the rearranged Preliminary Hearing (telephone). Therefore, struck out. Yay.
Bit of an anticlimax after the hours of angst deep in the New Zealand backcountry trying to format a WS on a mobile phone, and fight with the Court over unreasonable scheduling! Presumably they just punt these cases and hope the Defendant folds.8 -

The entire MO of the parking industry is acting like chancers and wasting court time, IMHO.

Not only failed to attend, had made no communication to the Court since initiating proceedings - didn't submit a case, didn't give their phone no. 7 days prior. So the judge, for the tape as much as for me, said that enough of the Court's time had been taken up already, and using his discretion, was striking off. But they already knew by Nov 27th (filing deadline) that they had blinked. I guess process has to be followed.
Interesting to speculate what would have happened if neither of us had engaged...4 -

It was just yet more effort to go for costs. I'm retired, so it's notional - mostly printer ink! As mentioned, I had to do all this on a mobile phone in the NZ backcountry.
I'm going to add my voice to calls for changes in the system though. It is absurd that they can limit their downside to 35 quid, and hope for default, while I could have come home to a done deal and hundreds spent in redress. Not even the courtesy of informing the Court or me of abandonment. There should be a deposit, forfeit on a no-show.2 -
