Would the £7k for your old car have still been applicable if you'd paid cash for the car, not financed it?

    Yes.

So how can it be a deposit for the finance, rather than a discount from the car?
No it wouldn't have been. The scrappage scheme was only eligible on financed new cars as far as I was aware.

It was also not to be used in conjunction with any other offer, but low and behold I received further discounts on top of the scrappage discount so the agreement has still been improperly executed no matter how you look at it
The link you posted back on page two strongly suggests otherwise.

No mention of finance being required at all.

As far as trying to unwind the whole purchase, six years after the fact, based on "They gave me a better deal than they advertised", good luck with that...

I notice from your thread elsewhere that you're already down £5k in costs on this whole legal adventure. Surely you have to agree that there's a point to cut your losses and not continue to dig yourself a bigger hole?

Again, when there's a vehicle finance lawyer who knows this stuff inside out telling me I have a case and I should appeal it on certain grounds, it's difficult to let it go.

I think the better advice I've received on here would be to consult a vehicle finance specialist barrister or equivalent, which I will be doing

Why are you asking for advice on another forum instead of hiring them to represent you?

It seems whatever is said here you're going to defer to this advice anyway.

They don't accept payment or offer representation.

In hindsight posting in this section of the forum has been a mistake, although it has been amusing to see the keyboard warriors out in full force.

On the flipside though, I have to say the debt free wannabe section of this forum are a lovely bunch

On the flip side you got your question answered.

There was no government scrappage scheme contributing to your finance, just a manufacturer’s marketing gimmick offering you a discount.

Otherwise you could have walked into the Nissan dealer next door and got £7k off a Micra - cash or financed.

Sorry you didn't get the answers you were looking for.  Good luck getting a court with a judgement you are looking for.

Thanks. The fact you don't know the difference between judgement and judgment says it all really

    That his typing isn't perfect?

There's no need to be rude to people who aren't giving you the answer you want. It's really not going to encourage anyone to be helpful.

I think a few posters on here could do worse than read through the whole of the thread on legal beagles.

I don't think the distinction between a discount and a deposit or "contribution" is as straightforward as many posters here think it is.  They need to look at how "deposit" is defined in the relevant legislation which is what the OP is arguing.

I'm not saying the OP is right, but I'm not sure others on here fully understand his argument...

How could the OP hire a "forum" to represent them?

    Have you read the argument?
