I am actually moving sometime this year so will be sure to let them know if I do -
(iii) Vine v London Borough of Waltham Forest: CA 5 Apr 2000, where Ms Vine won because it was held that she had not seen the terms by which she would later be bound, due to "the absence of any notice on the wall opposite the parking space''.
I will be adding this to my file.1 -
So, after being rebuffed by Costa, I replied telling them I will be contacting my MP. Which I did, and also sent an email to Philippe Schaille - CEO.
My case has now been escalated to a team Leader who asked me for proofs of purchase - always pay cash so none of them. And details of my order - was so long ago, can't recall. Copy of my PCN, binned those so sent photo of the LBA.
She told me while they 'can't promise anything' they will raise the matter with the provider on my behalf.
Fingers crossed.1 -
Well, got knocked back by Costa customer services - looks like I'll be swotting up again on defending this.
"Please be advised that we have reached out the the partners that operate and own this store and unfortunately, due to the lack of PCN number and the time that has passed since this fine was issued we are unable to assist further at this time.Once again, we would like to apologise we cannot assist you any further with this matter"0 -
Write back to whoever it is at Costa that "knocked you back" and point out their ignorance of these matters if they think that you are complaining about a "fine". Explain that you have not received any "fine". What you received was a speculative invoice from an unregulated private parking company for an alleged breach of contract. This unfair invoice was issued to you, a customer/patron of their business.
If they are unwilling to intervene in this matter with their agent, then not only will they lose you as a valuable customer but you will warn as many people as possible on social media that they should avoid spending their money there as they are likely to be also invoiced for an additional £100 by an ex-clamper private parking company.2 -
Have done, thanks. Can't see how they can state 'lack of PCN number' when the reference on the LBA, my name, my reg, date of breach, and address of the Costa car park should be everything they needed. I have since found out that the partner they referred to is The Adil Group. So will try and contact them, see what they say on the matter.1

What do they mean by "reached out"? Did they stand outside their coffee cabin with their arms upraised? Maybe they would have had more success if they had phoned (backed up in writing of course) and INSTRUCTED the PPC to cancel the PCN and stop aggravating and annoying their customers because, if this carries on, they won't have any customers and will have to close and have no need of parking management!Unkas said:Well, got knocked back by Costa customer services - looks like I'll be swotting up again on defending this.

When I told Costa C.S my MP would be contacted, it was 'then' a team leader contacted me and said they would love to liaise with the MP directly. Sadly, my local MP was about as useful as an ashtray on a motorbike - giving me a long list of information you could find on here in 2 minutes. Either you lot are in the wrong jobs or he was nothing but a spineless coward.2

Wrote to the Adil group who run this Costa last week, heard nothing back so moving ahead with the email to put the LBA on hold for the additional 30 days as the letter was dated 30/04/2024 today is 22/05/2024
I sent it to Legal3@ce-service.co.uk if anyone knows if I should have sent it elsewhere, info appreciated in advance.
Thanks0 -
Looks like you did it all right at this stage.
But why didn't you get the first PCN and appeal it? Was the address on your V5C wrong?
