    Thanks all for the help.

    Draft 2.0 is available here:

My deadline for the 'early payment' in Thursday so would welcome thoughts on how likely this appeal is the be upheld.

    Thanks

Remove the unneccesary and ungrammatical first paragraph.

POPLA won't follow links, so instead, show screenshots of things like the Beavis case yellow sign & whatever the Blogspot link is.

Paragraph 4 is wrong.  The current 2024 BPA Code of Practice is easy to Google or find on the BPA Website where you'd expect, and it has changed several times since that old version you've quoted.  You don't get both a consideration period and a grace period added together.

The one you copied also says that the photos don't show the vehicle at all. That's rare. Are you sure?!

  • Thanks, I will implement those changes.

When you say paragraph 1, are you referring to section 1 or literally the first paragraph?

re. The images. There are two time-stamped images of the car entering and leaving, with 2 ‘close-up’ images of the reg below. The wording I think you’re questioning refers to the bottom two images.

I mean the horribly badly written intro paragraph.  We hate that one.  People keep copying it even though it's pointless telling POPLA that stuff and includes so many commas it is ungrammatical.

The wording I was talking about has in brackets something like "the images don't show the vehicle at all!" which I recall was used in a case where the image showed an empty entrance!  Does not make sense in your case.

Removed the first para and updated with BPA 2024 wording. Also added screenshots of images.

The BPA CoP doesn't allow two grace periods.  Only a minimum of 10 minutes.

Don't bother with the point about inaccurate ANPR.

Thanks! Removed broken link and ANPR section. No mention of two Grace periods now.

I can't really comment again (even though I tried to narrow the issues for you earlier) as I don't suggest people try POPLA for overstays and certainly not ParkingEye cases.  I do not see any point there winning at POPLA.

You are better off ignoring the thing and defending in court, if all your efforts to get the landowner to cancel it have fallen on deaf ears.

  • Hi all,

I finally got through to Stafford Soccer Centre and they have said they will cancel the PCN!!  :D

As I submitted to POPLA in the meantime, ParkingEye have since commented on my appeal. Do I still need to respond to their evidence or do I just stop now and assume the PCN is cancelled?

    Thanks
