Parking Eye PCN, 15 minute overstay, POPLA Stage

Hi all,

This is my first post so thank in advance and apologies if this is the wrong way of going about things.

I recently received a £60/£100 PCN from Parking Eye for overstaying in a private car park. I paid for 4 hours and the ANPR recorded my entry to exit time as 4 hour 15 mins. The signage at the car park indicated the first two hours were free and so I waited for 2 hours before paying for 4 hours to cover the remainder of my parking. Sadly on reflection I clearly didn't read the sign properly as it does say that 'all tariffs include the first 2 free hours'

In a naïve panic I appealed to PE on the basis that the signage was unclear and that I had clearly intended to pay (attached my receipt for 4 hours). Of course this was rejected by PE and I now need to decide how to proceed.

What are my chances if I take this to POPLA? Am I better off taking the £60 on the chin or risking paying the £100 if I appeal.

I have read the NEWBIES thread but was unsure if the example letter is still the most up to date example to use in the case of an appeal?

Thanks!

It is up to date but there isn't a single example letter there for POPLA.  You don't send the first template appeal at POPLA stage.

But when you read the NEWBIES thread:

    - what did you do about Plan A (not appeal)?

    - what did you see when you compared your NTK to my thread of NTK pictures linked there?  POFA or non-POFA?

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hi, thanks for the response.

Ah I see, so at POPLA stage its just a case of creating my own 'pdf' based on the successful ones available in the thread and adding/tweaking for my own case?
  • Apologies for the double post- I sent the other early and am unable to edit it.

Re. Plan A- I'm afraid I don't know who the car park owner is, I was parking for a football match at stafford soccer centre but they do not own the car park.

Re. the NTK, unfortunately it does refer to POFA on the back and has timestamped ANPR pictures.

    Thanks

The Beaconside Group (developers) lease 45 acres including the Soccer Centre but the owners are Pan America Asia Ltd - incorporated in Hong Kong.

  • Thanks GrannyKate, would you be able to advise how to find the relevant CEO's email address? Having some trouble finding online. Thank you.

Thanks GrannyKate, would you be able to advise how to find the relevant CEO's email address? Having some trouble finding online. Thank you.
There's a website detailing CEO email addresses. There is an auto block applied on this forum (for whatever reason) whenever we post a link. But if you type in 'ceoemail dot com' that should find it for you.  Have a look there.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Thanks all for the help and apologies that I'm proving pretty useless at this, I tried the suggested CEO website but couldn't find an email, I did find the CEOs name however that has also not yielded anything other than a (out of date) linkedin account.

    Any ideas?
