    Change the awful Americanism 'parking lot' to car park before I (or the Judge) will explode!

    Remove 'according to the BPA Code of Practice' from the end of para 4

    ...because the BPA have disingenuously weeded it out & pulled the rug on observation periods in recent years which is why you are using REAL fairness instead! The Green button case and the DLUHC Code state the legal position on contracts properly, not the BPA CoP (now).

    Fair enough :)  I have replaced 'parking lot' with 'car park'.

    And removed the BPA code of practice reference under 4. Under 9, I called it the BPA recommendations of best practice.

    Damn, how embarrassing, I just noticed that I signed 2/4/2024 instead of 2025...

    I guess I can send a revised defence which is correctly dated? 

    Anything else I need to legally consider?

    Ok, as the deadline is today, I have now sent a revised Amended Defence which shows the signed date correctly and made the Claimant aware that this copy is served to the court as well.

  • I parked in the Red Lion car park (41 The Green, High Wycombe) and was there for 21 minutes.  I have just received a parking ticket from Britannia Parking for £100, or £60 if I pay early.  Is this legal?  It looked like the pub car park and the entrance to the pub was in front of my car.  I did not see any signs, although that is not what I would look for in a pub car park.

    Hi All,

    Update: the Claim has now a hearing allocated on the 31st of July. It sounds like the witness statement is due 14 days before that date.

    Also DCB legal has contacted me about settling the case and offered me 80£. I didn't respond to their offer and they have now sent a new offer for 60£.

    I find the wording interesting as well:" To assist the Court in achieving its overriding objective, our Client may be prepared to settle this case. I can confirm our Client would be agreeable to £60.00 in full and final settlement of this Claim."

    Its doesnt have any effect on any court proceedings if I dont seem to be open to negotiations, does it?

    Do the offers come marked as "Without Prejudice - Save as to Costs"?  If so, it cannot be used in the hearing until after the judge's verdict and only then to determine the level of costs awarded to either party - hopefully yours.
