Please find DCB Legal's response below."We write in response to your correspondence received in our office on 5th August 2024.
For the avoidance of doubt, DCB Legal have been instructed by our Client, Euro Car Parks Limited, to pursue you for the Parking Charge Notice issued on xxx xxxx at Astle Retail Park, and unless we are instructed otherwise; or the payment of the outstanding balance of £170.00 is made, we will continue to issue legal proceedings.
For the purpose of clarity, the sum added is a contribution to the actual costs incurred by our Client as a result of your non-payment. Our Client’s employees have spent time and material attempting to recover the debt. This is not our Client’s usual business and the resources could have been better spent in other areas of the business. Had you of paid as per the Contract, there would have been no need for recovery action so the amount due would not have increased.
Please note, the HMRC ‘VAT Supply and Consideration manual’ (VATSC06140), which was last updated on 02 September 2020, confirmed that Parking Charge Notices fall out of the scope of VAT.
As per your request, your file will remain on hold for 30 days from the date of this email. After which, payment of the outstanding balance of £170.00 will be due. Failure to make payment will result in a Claim being issued against you without any further reference.
Payment can be made via bank transfer to our designated client account: -

- Sort Code: xxxxx
- Account Number: xxxx
You must quote the correct case reference (xxxxxxxxx) when making payment. If you do not, we may be unable to correctly allocate the payment. If further action is taken by us as a result of an incorrect reference being quoted, you will be liable for any further fees or costs incurred"

Hi Guys,
I have now received my claim form.
Just to confirm at this stage I just need to Acknowledge Service of the claim, which I assume is only done by postal, right? Can I omit sending the defence and counterclaim form or does it need to be sent completely empty?
Then afterwards as I am not filing in a defence using their forms, I got 28 days from the date of service of the claim to send my defence. I would send this by email as advised.
The court is CNBC and a gov.uk website search gave several emails of which I would pick ClaimResponses.CNBC@justice.gov.uk. Would you say this is the appropriate email address to use for the defence letter?

Thank you, I haven't seen the link on how to AoS with MCOL, looking closer at it, the claim form mentions that a response is possible online. My bad. This has now been actioned.
Issue date of the Claim form is 16/9/2024. So Date of service is 5 days after.

That's four weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.5 -
Hi All,
just keeping you updated. I have filed a pretty much standard defence. In the personal section I just reiterated that I have never received the PCN as issued on the date given and that due to the aged nature of the claim, I dont fully remember the purpose of the visit, however, after some research can confirm that on the day (time is not given in the claim form) I have used the car park since I still have a receipt for 2 hour parking. (So haven't given any more information than already on the claim form).
I have also now received the Claiment's N180 and am waiting for mine. Non surprising DCB legal wrote within their email that "Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim". and that they are willing to consider settling the case if I contact them within 7 days. Just hoping that their time is too precious and they wont actually make a court appearance, as previously mentioned DCB legal seldomly do. Cant imagine this is lucrative for them at all.
I am now waiting to receive my own questionnaire. Will this come by email or post?

Definitely by post from the CNBC in Northampton, login to MCOL and check your claim history to see when they post it
Once posted, download the N180 pdf from the gov website, fill it in and email it to the DQ email address , cc in DCB Legal too2 -
