    As ever, regarding this Anglian buy out (or whatever it's technically called), the devil will be in the detail.

    We ordered Everest Exclusives range triple glazed casement windows which are A++ energy rated & come with a 20 year guarantee. Anglian triple glazed casement windows are A+ energy rated & come with a 10 year guarantee. No doubt there will numerous other differences also. So unless Anglian propose to complete Everest orders using the exact same Everest system, they won't be like for like. Certainly not if they're intending to fulfil these orders by switching to an Anglian system instead. That's not to say that Anglian is necessarily a lower quality than Everest (or vice versa), but they're not exactly the same. It would be like ordering a Ford Focus & receiving a Vauxhall Astra instead. 

    I have emailed Anglian to ask for clarification on this point & will share any reply I receive.

    Good idea.

    There may be a decision for people to take on the matter.  On the face of it, if the plan is for Anglian to fulfil the order but with their units and guarantee, that is inferior to the original order.  However, would rejecting that simply put a customer back in the queue with the administrators for what will probably be pennies in the pound?

    As you say, it may well come down to an individual decision. And it could be that what method you used to pay Everest will be a deciding factor for each.

    To your point - it will be them opportunistically picking up contracts for people who agree to downgrade at same cost. And I really doubt they will warranty products they didn’t make or only partially installed.  


    Also make sure you compare tech specs - I can’t find them on Anglian’s site (only company that doesn’t seem to post them) … as well as trickle vents (Anglian in sash, Everest in head), seals & beading & hardware & locks.   I would never  re-sign without making sure I compared every aspect & also saw an in situ product.

    Absolutely. Anglian aren't picking up Everest customers because they feel sympathetic towards them. It is a purely business driven opportunity on their part & if they can supply Anglian windows where people have on average paid more at Everest prices, that's great business for them. Hopefully, we may know more about the detail this week...

    I fear it will be a 'take it or leave it' situation.  What are people without chargeback/S75 options going to do if the offer is a lesser product?  Turn it down and join the queue of creditors?

    Given the offer on the table.
    No chargeback as product is being supplied.
    Same would be argued on S75, that there is no breach as product is being supplied. So not taking the offer would be seen as customer breaching contract.

    I'm not sure that you would be breaching contract by refusing the offer if the product offered is different and/or inferior to what you had ordered. Section 75 applies where a breach of contract or misrepresentation by the supplier of goods or services has taken place. In the event of being offered an inferior product as a replacement, why would that not apply?

    You can easily show it’s an inferior product by comparing specs.  This isn’t the contract being assumed - you would need to sign a new contract.  The contract you signed wasn’t satisfied as company out of business - you aren’t breaching. If the company was sold, that’s different. Anglian is simply sub contractor here as all of Everest’s employees (save sr mgmt now running Evolution) are gone, as are their own contract installers.  


    But for people like us - part way through an installation and dealing with an open RSS after a year of installation errors, damaged & incorrect items, mis-representations and the like    - there’s no way Anglian can do it. I would be shocked if they agreed & waranteed for <20% of the contact cost. And they don’t make the same product - we aren’t going to have a window with two different beadings in each pane. Or that our door is 70 mm composite and they sell 44 mm… 

    It’s going to take awhile to frame the section 75 - but I wouldn’t think it’s hopeless. We are going that route.
