Hi all, first post on the MSE Forum.

We too have got caught up in the Everest administration situation. Ironically, this happened on the same day that the surveyor visited our house. So far, only our deposit of £3,600 has been paid (on credit card) as 20% of the £18K total agreed. It appears that we avoided the next payment of a further 65% by just a couple of days, thankfully!

Like Guest2025 has asked, I'm also keen to know when (how soon) I can submit a section 75 claim? My preference would be to get my deposit returned & go elsewhere for my windows, even if Everest somehow continues in any capacity.

Lastly, I notice that the Everest website is now down. That wasn't the case earlier this week when it opened up as normal but with a notice from the administrators at the top of the page. Would this be considered an indication that the company is no longer trading & therefore unable to fulfil its orders, enabling Section 75 to step in?

They're questions for your credit card company who I suspect will want to wait until they know the final status of the business before shelling out thousands of pounds in refunds to what will probably be lots of customers in a similar situation.

If the business continues to operate, you'll need to look at the terms of the contract to see if they allow you to cancel without penalty.
I have no doubt that they will want to wait for obvious reasons, as you say. My point really was more about whether or not there is a reasonable case to present now, based on all current indications that Everest are no longer trading. All said & done, the banks don't necessarily have to like it. Ultimately this is about consumer rights, not what the banks would prefer we all do.
Agreed, but by the same token, the finance provider might take the stance that until the business is officially closed, they are not bound to do anything, and therefore aren't interested in whether a website being down is a reasonable indication of a business likely to close completely.
And that's the part I'm not sure about, hence the question. But it's not just about whether the website is functional or not. Resolve have stated that the company is insolvent &, according to the Citizens Advice web page on Section 75, that infers that they've gone out of business. A possible grey area? I don't know...

All you can do is ask your credit provider and see what they say.

Yes, I agree. Submit the claim & the worst they can do is reject it for the time being...

And good luck to everyone caught up in this mess.

When I spoke to Everest sales rep this morning he gave me the impression that assets had been passed to Anglian. So it might be possible for them to fulfill existing orders.
    Not holding my breath though...
Even if that is the case, it's highly unlikely that Anglian (or anybody else) would continue with several different frame systems etc. Much more likely that they would take over Everest & streamline the combined business, which may well mean that any orders wouldn't be completed to the same spec as agreed. That in itself opens up a whole can of worms...

You don't. You submit a chargeback. As it is quicker.

I'm down £23,972 paid by debit card. Only found out today, when chasing Everest up for an install date, then the ReSolve letter arrived this afternoon. Have tried the chargeback option via online form for both payments. No confirmation /response from NatWest. No NatWest phone number anywhere on their site either. Do banks still employ people at all?

It will take them time to look at your claim & action it.
Remember that NW will be receiving hundreds or thousands of disputes a day. So it takes time to work through them. Never mind in terms of Everest, banks are talking to Visa/Mastercard about the situation & how they will progress it. As they are only in administration. Not fully gone bust.

It's a near certainty that a chargeback would be blocked by the administrators, hence Section 75.

Yes, though as you leave your email and tel number as part of the online process then some form of automated response would be appreciated. "We got your request and will process it within x days etc..."

The only reason they could use would be that they are supplying the goods. S75 is not a get out of jail free card. Your CC will go chargeback route, as they can reclaim the money, rather than payout out themselves.👍

Never known a administrator decline a chargeback on any case worked.

The first thing a Liquidator/ administrator does is close down any deposit accounts and move those funds to their account. I am dubious as to whether a chargeback would be successfully done if there are no funds in the original account that was transferred to.
