PIP appeal rejected what now?

    Calling on your experience here.... their lack of apparent signing of their PIP2 form or any sight of it... is it conceivable DWP proceeded without a PIP2 form and they essentially had an assessment type call instead (DWP or independent)? (I'm thinking they must have stood a very high chance of getting an assessment of some sort but don't mention it...) .There are things here that don't make much sense including the lack of explanation for decision in the MR letter (which I assume was not sent in error like mine recently!). ETA.. the most recent post from the Op listing evidence used for decisions suggests there is a completed PIP2 and that for MR (if not before) the DWP commissioned 'health professional supplementary advice' which I assume was a paper based report from assessment company.

    If it did go to appeal and they do have a PIP2 form completed and they haven't ever seen it (prior to its use in taking the decision) presumably that would be something to point out to tribunal and how it was filled in to prevent any great burden of explanation of apparent (if there is any and I suspect there would be) contradiction.

    olderandwilder in the decision letter (the first if not in the MR decision) does it list the evidence used to take their decision and if so what do they list?

    I looked at all the information available to me including the how your disability affects you form. This tells me how much help you need.

    I have never set eyes on this form. There was nothing else to fo on because the woman on the phone (dwp) said she had enough info.

    The rejection of the mandatory reconsideration says 

    How I made my decision

    I looked at all the info available to me including:
    .the hiw your disability affects you form

    The information provided by the health professional supplementary advoce

    The I formation provided by the report from your psychiatrist and

    The extra information you gave us.

    I added a dozen or so pieces of evidence, including 3 seperate reports deom 3 different psychs (one on the autism, one on the ADHD and one on the PTSD.) Plus letters from people who care for me, evidence from the DSA, the physio etc.

    They haven't responded to a single point raised.

    The first rejection had a page and a half on why they weren't giving me it full of things that simply weren't accurate (or relevant) at all. 


  • I think this all hangs on that first form, which I won't get to see in time to use it in my appeal.

    Important I think tomorrow to request:

    the how your disability affects you form (PIP2 form)

    The information provided by the health professional supplementary advice (this sounds like a paper based independent report)

    Sight of these documents (and any other evidence they gathered which isn't mentioned or provided by you) at least then enables you (or those helping you like CAB) to understand what evidence is currently in play. I'll default to Alice's advice on how to deal with a PIP2 form submission that you (or anyone representing or assisting you) have  never seen or signed prior to these decisions as normally this would be your declaration of your relevant disablements and other information.

    "They haven't responded to a single point raised." - they often won't... they can sound very dismissive (they even said to my point that they got my wife's name wrong that I should take it up with the assessment company - for what end...lol.. to convince some stranger I know my wife's name? I raised it to undermine the accuracy of the report to other facts which were relevant to disablement) often regurgitating language from the first decision... although in your case you're saying they have not explained the decision which sounds odd.

    If you are concerned that you have little time left to appeal, you could send the SSCS1 form in to lodge your appeal and supply further detailed reasons later.
    Once your appeal has been received you will get an acknowledgement, then in due course you will receive a "bundle" of all the paperwork that the DWP has got regarding your PIP claim. So you will get sight of the PIP2 form, if you don't receive a copy on request now.
    I certianly urge you to seek advice, free from Citizens Advice (and it could be by phone if a face-to-face appointment is unsuitable for you)  and/or Benefits and work - money well spent to join that organisation.

            That could indeed be possible, especially as the OP states he did not see or sign the document. 

          Given the chronology is not clear, I do think it important that the OP gets help from Citizens Advice (or another welfare rights charity), and preferably is allocated a caseworker.

        If a PIP2 form was not completed, then the written submissive to the tribunal becomes even more important. It should clearly set out why a PIP award is appropriate (in effect setting out the points as a PIP2 form would).
