Then complain to instavolt by email info@instavolt.co.uk complaining about the restrictions imposed on a 24hour site
I believe that the Tesla app tells you these things beforehand, possibly on the website too
There is an instavolt set of bays a mile or so away from me on a McDonald's car park, limited to the same 90 minutes stay as customers to the fast food restaurant2 -
Here are some reviews of this site from the Instavolt app

You can imagine how many of those victims just paid into the scam. So much low-hanging fruit on the gullible tree for PE to cherry pick.3

ParkingMad said:According to the Instavolt website, the EV chargers at Gissons Hotel are permanently available 24/7. No mention of any conditions about registering with the hotel.

reliag17 said:Hi allAn update if you are interested. So I sent an email as follows:"To whom it may concern.
I have received a Final Notice (as attached), in relation to the parking charge at Gissons Hotel, Exeter.
To reiterate, I was NOT parking, I was charging my EV and no Parkingeye signs were placed at the charging bays. Therefore, no contract with Parkingeye exists.
I have complained to The General Manager at Gissons Hotel who stated that he would try to get the PCN cancelled.
Please can you tell me whether the cancellation request has gone through?
I look forward to hearing from you in due course.
Regards"And Parking Eye have responded as follows:"Dear Sir / Madam,
Thank you for your correspondence in relation to the Parking Charge incurred on 08
January 2024 at 15:12, at Gissons Hotel, Exeter car park.
We recently sent you a Final Notice which informed you that this Parking Charge remains
outstanding and had now been processed for further action. This is because your appeal
to POPLA was unsuccessful and the independent adjudicator found in Parkingeye’s
favour. You were advised in their appeal decision to pay the full Parking Charge in order
to avoid further action.
We can confirm that the Parking Charge amount remains outstanding and full payment is
required to prevent further action.
If payment is not received, this case will be reviewed and further action could include
referral to a Credit Reference Agency to confirm the correct address, instruction of
solicitors to secure payment, referral to debt recovery or the issuance of court
proceedings, all of which will incur further costs.
Yours faithfully
Parkingeye Team"
...they didn't actually answer my question but hey-ho.
If the area does not have PE signs, no contract exists
PE signs are very poor anyway.
POPLA
These bods will side with BPA members and are totally useless
POPLA knows they now have a short life as soon government will introduce an idependent appeals service soon
Regarding the credt reference agency, they will do a soft search which means nothing will show on your credit report
IF IT DOES YOU CAN SUE PE
They cannot claim a debt because there is none unless a judge decides so. However, ParkingEye would be BARKING MAD if they took this to court. Of late we have some daft cases from PE and a so called legal they use
A judge would make mincemeat out of PE
I would contact the company who own the chargers, telling them that a cowboy parking company is trying to extort money for using their property
Explain all this to the General manager of the hotel and insist he gets this PE rubbish cancelled
And warn the General manager that PE will no doubt respond by saying that POPLA supports them, Well ParkingEye and POPLA are part of unregulated industry and it matters not what they say
DO NOT PAY DESPITE THEIR STUPID THREATS

Dear ParkingEye,
How scary (not):
"If payment is not received, this case will be reviewed and further action could include referral to a Credit Reference Agency to confirm the correct address, instruction of solicitors to secure payment, referral to debt recovery or the issuance of court proceedings, all of which will incur further costs."
Big wow.
Go on, I dare you: spend 28 pence on a bulk soft trace with a CRA. Why do you write in such an aggressive way? See you in court.
yours sincerely,

I wonder why Parking Eye now resort to rubbish letters ?
It must be the bad company they keep with the other rubbish letter brigade2 -
Hi all.Thank you for continued comments and advice - it's nice to know you are not alone, (and that many people are as angry as I am that this daylight robbery is allowed to legitimately continue). To confirm, the overarching advice is to sit tight and not pay.Should I reply to ParkingEye's last response?0

Could you find out from either the hotel manager or from Land Registry who owns the land next to the hotel where the EV chargers are, and complain to them?I can see the location listed on the Parkopedia app. There are separate tabs for parking and for EV charging. Nowhere on the app does it state that you also have to pay for parking if you are charging an EV.https://en.parkopedia.co.uk/parking/carpark/gissons_hotel/ex6/kennford/
I found this photo of the tariff board on ZapMap. It says that the first hour is free but on the Evology Parking app the minimum fee is £4.25 for 3 hours. It is not possible to pay for less than 3 hours. I believe the first hour is only free if you are able to register with the hotel reception when it is open.
Motorists who spent under 30 minutes charging have received a £100 PCN.2 -
So the terms are impossible to comply with. Send PEye my suggested reply. I wasn't joking.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
