    vehicle was not parked, it was re fuelling (all be it with electricity as opposed to petrol )

    so parking restrictions should be irrelevant , as the n the case of dropping off/unloading etc as per jopson vs homeguard

    An interesting response from Instavolt, apart from them using the word fine 

    The ones that I have seen have been at McDonald's or hotels etc, where the parking restrictions are being applied regardless of the circumstances, so it seems that Instavolt customers are generally not aware that maybe they have to register the VRM for exemption, or obey the signage rules, but just park and charge regardless of the rules or the time of day or night. Which may be restrictive or unfair in the circumstances 

    I heard that the Tesla app conveys warnings etc about any restrictions or VRM registering on their sites before customers get there, plus extra signage at the EV bay 

    It seems clear to me that plan A is most definitely the best option here, as it usually is, but the OP may need to be as dogged as a dog with a bone

    That's not the appeals team. It's debt / litigation and they WILL consider this even if you already appealed and got nowhere:

    Tell them you were charging your EV and no ParkingEye signs are placed at the charging bays. So no contract with ParkingEye exists and you have complained to Xxxxxxx at the Hotel who is trying to get the PCN cancelled.  Ask ParkingEye whether the cancellation request has gone through; if not you will see them in court because this is sharp practice. 

    Make it sound like you are assured the PCN is to be cancelled. Don't call it an appeal.

    Is Exeter your patch for work and do you live in the area ?
    Be aware that West Country courts are not very fond of parking companies, especially those  who try to extort money because you are charging your car.

    Winchester is on the same circuit as Southampton who don't like these parking companies either

    Hi all

    An update if you are interested. So I sent an email as follows:

    "To whom it may concern.
    I have received a Final Notice (as attached), in relation to the parking charge at Gissons Hotel, Exeter.
    To reiterate, I was NOT parking, I was charging my EV and no Parkingeye signs were placed at the charging bays. Therefore, no contract with Parkingeye exists.
    I have complained to The General Manager at Gissons Hotel who stated that he would try to get the PCN cancelled.
    Please can you tell me whether the cancellation request has gone through?
    I look forward to hearing from you in due course.
    Regards"

    And Parking Eye have responded as follows:

    "Dear Sir / Madam,
    Thank you for your correspondence in relation to the Parking Charge incurred on 08
    January 2024 at 15:12, at Gissons Hotel, Exeter car park.
    We recently sent you a Final Notice which informed you that this Parking Charge remains
    outstanding and had now been processed for further action. This is because your appeal
    to POPLA was unsuccessful and the independent adjudicator found in Parkingeye’s
    favour. You were advised in their appeal decision to pay the full Parking Charge in order
    to avoid further action.
    We can confirm that the Parking Charge amount remains outstanding and full payment is
    required to prevent further action.
    If payment is not received, this case will be reviewed and further action could include
    referral to a Credit Reference Agency to confirm the correct address, instruction of
    solicitors to secure payment, referral to debt recovery or the issuance of court
    proceedings, all of which will incur further costs.
    Yours faithfully
    Parkingeye Team"

    ...they didn't actually answer my question but hey-ho.

    It won't incur YOU any costs if you win in court 

    Nobody is interested in credit agencies or debt collectors or debt collectors charges 

    The proof of the pudding is when a judge eats it in court

    According to the Instavolt website, the EV chargers at Gissons Hotel are permanently available 24/7. No mention of any conditions about registering with the hotel.
