Failure to provide a copy of the email (including all headers) response to your appeal will result in an official complaint to the BPA. If they are unable to provide the necessary evidence, they should resend the appeal response with a new POPLA code which will be valid for at leat 28 days from the new response.
Have you shown this to the BPA now?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Alexfw24 said:Hi all
First of all I have done appeal and being rejected and all that things I shouldn’t have done (let them know I was driver etc ) I have done 😮💨
.. . And I first received this charge letter in new year time although it said it was generated 18th of December. I then appealed explain the situation plus to advised this was only received in January after new year , due to the Christmas holiday . We received nothing after the appeal confirmation. Then in march a £170 charge from debt recovery company , I phoned to explain again and they simply don’t care just ask me to pay or I would be taken to court.I am happy to pay whatever I ought to pay (even though I feel this company does seems to be dodgy as many of others had the same issue with their app, also have no reply after appeal) But I don’t think it’s fair I did not receive appeal result then jump to debt recovery company. The smart parking company insist they did reply appeal result on 22nd of Jan ( at first they told me 19th of Jan) but I checked inbox and junk multiple times and nothing found .And I requested SAR from them the only reply they sent was listed after an email I sent in March(this was the one they said it was sent to me in Jan but never received by me then ) . I don’t know if it suppose to be listing in order and they won’t confirm this either.
it is causing me stress that affecting my life and to my child as I constantly worry if I will missed any letter or email.
Short notice but do the survey now (and then a short & friendly video call next week) to tell the Government's consultancy outsourced firm your experience of 'appealing' and being told 'we sent you a rejection letter' (but you didn't get it...no proof they ever emailed it:URGENT
Please earn £60 and help us push the regulation of the parking industry and new appeals service over the line.
There should be appeal (ADR) available at ALL stages to keep cases out of court. And proof of actual date of posting or emailing rejection letters.

Same as all these:

https://forums.moneysavingexpert.com/discussion/6525173/smart-parking-penalty-error-and-now-debt-collector-letterI suspect this might be DR Plus causing it. Smart have blamed DR Plus before. I suspect they do the back office appeals for Smart and just deliberately or negligently, they (or Smart) drop the ball in a lot of cases and overlook appeals.
Smart Parking had a similar 'problem' once before, and had to admit it to the BPA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

nopcns said:Stop stressing. You are dealing with the intellectually malnourished people at (not so) Smart Parking. Stop thinking about paying these scammers. No one pays them unless they are over ripe fruit that has fallen off the gullible tree.
Yes, it is a pity you didn't find this forum before you blew the best chance to get this cancelled once and for all by revealing you were also the driver. Never mind. Not much you can do about that now.
They will show you win their SAR response that they did send you a response to your appeal with a POPLA code, even if they didn't actually do so. Not surprising as they have to pay for a POPLA code and that doesn't help them with their scam.
You should complain (not appeal) to them that you never received the response to your appeal and whilst you cannot evidence that you didn't actually receive it, (not so) Smart Parking cannot evidence that they did actually send it and you require them to resend the appeal response with a valid POPLA code. Tell them that failure to do so will result in a complaint about them to the BPA.
The most likely outcome, however, is that you will continue to receive a load of useless debt collector letters. Refresh yourself about how these debt collector letters are to be ignored as advised in the Newbies/FAQ thread. It is doubtful whether they will ever progress this to a claim, but if they do, this is where you will win.
My fiancée received 2 letters from Smart last week relating to overstaying in her work car park by 18 minutes each time, on 4th and 5th June(so letters took around 24 days to arrive after the incident date). She has parked there maybe another 6 times since then so it's possible another ticket or even multiple could arrive in the next couple of weeks(she won't be parking there again going forward but with the backdating this may already be in process).
General advice from friends etc is to just totally ignore the tickets, even if more come so a few have stacked up. I have just read the Newbies thread and seen the template, is it worth doing this rather than ignoring it, or would it probably be the same result(that nothing should happen)regardless?
I have also seen some threads were people have moved and there is some advise of writing to Smart to ask them to change your details. These letters are going to her parents house but she did actually move in with me last year so we could do this. I didn't really understand the relevance of doing this, but I guess could be worth doing?
Thanks and apologies if I'm going over much covered ground.0 -
If you require advice you really need to start a new thread, but briefly
I would NEVER recommend ignoring a private parking charge notice, especially not one from not so Smart
Smart usually fail to comply with POFA 2012 , so no keeper liability meaning easily seen off , usually with the First keeper appeal, correctly worded, providing its appealed before the 28 day deadline of course
No blabbing about who was driving either
As for the address, as long as its a valid address where post can be picked up quickly, say once or twice every week, no need to change it, as long as everyone is in agreement and communication is good, because people need to act promptly when letters arrive
If you want further advice, please start your own thread, thanks3 -
Dead easy to appeal & beat. No-one should be ignoring private PCNs unless in Scotland or NI.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
