Smart Parking and Debt Recovery Plus

Hi everyone.

I have read the Newbie Thread and searched the forum and can't find what I need to do next.

I got a PCN from Smart Parking in December - followed the appeal instructions in the newbie thread. They replied saying they received the appeal and they would endeavour to reply in 35 day. I heard nothing until last week when I received a Debt Recovery Plus letter - it was well over the 35 days. I haven't replied to DRP.

I can see from the forum that DRP are toothless but I don't know what to to next. Do I ignore them? Do I do a POPLA appeal? Do I reply to Smart Parking's receipt of appeal?

    Plan A is always a complaint as keeper to the landowner and your MP.

    Complain to Smart that you did not receive a PoPLA code (you can't appeal without one). Give them seven days to respond otherwise you will escalate it to the BPA.

    If they provide a code (which is unlikely) then appeal to PoPLA as per the third post of the NEWBIES.

    If they fail to respond, or pretend they sent a reply but tell you it's too late to make a PoPLA appeal, then complain to the BPA that one of their ATA members failed to provide a PoPLA code and went straight to debt collection which is a breach of the BPA CoP.

    Send Smart a complaint (then the BPA if Smart don't cough up a POPLA Code).

    Thanks for your help everyone. I sent Smart an email to tell them I would go to the BPA over breached code and I received an email to say the PCN is now cancelled.
