Hello All, I have now received a Letter of Claim from DCB legal for the PCN, stating the usual threatening nonsense.

My wife was heavily pregnant at the time, and was unable to drive the car, resulting in her leaving the car park twenty or so minutes late.

She expressed this in the first appeal, but it was rejected. We missed the second appeal, as we believed that there was no need to respond anymore after their pathetic attempt at reducing the fine to £50.

I will read the newbies thread and find out what I should be placing in the response, and will update you all here with what happens.

If anyone has any advice for us, it would be much appreciated.

As said , refer to the Newbies thrad

Interesting that DCBL admit to dent collection charges ? THAT'S THE FAKE ADD-ON FOR £70

Debt collection is subject to VA so ask them for a VAT invoice

They will reply that parking charges are exempt from VAT.   .... they will try to mislead you ... saying parking charges are exempt from VAT which they are ... BUT NOT DEBT RECOVERY CHARGES

This is an issue for HMRC to investigate DCBL
You can report them to HMRC

AND .... when they refer to UKPC signs, they are unreadable unless you have binocularsThis DCBL rubbish is yet another prime case that will end up in the DBL DISCONTINUATION THREAD

Play the game with these bods and enjoy

LOL "to assist the court".  It's not at court yet!

I have now received a Claim:

There are further pages detailing how I can admit/partially admin, defend, or counterclaim. According to the Newbies thread, I am to send the LoC template directly to the email of the solicitor named at the bottom of the Letter of Claim. I will do that and update this thread if I get a response.

Looks like you have received a Claim Form, not a Letter of Claim.
You showed us the Letter of Claim you received back in the summer - on 17 July at 1:42PM.
You are past the point of sending a LoC response to anyone. You have a Claim to defend yourself against.

You have left your MCOL password clearly visible on that image you have shown us.

With a Claim Issue Date of 7th November, you have until Tuesday 26th November to file an Acknowledgment of Service, but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 10th December 2024 to file a Defence.
That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • Thank you for your advice. I will take a look at the newbies second post and do as advised.

    No you aren't!

You'd get a CCJ if you do that.

Slow down and read the right bit, about how to do the AOS then defend a Court Claim.

    I've redacted the Password properly.
