  • A small update:

    I think the parking company have been trying to call me. I say "think" as I can't use the phone as previously mentioned but have a screening service so I'm pretty sure it was them.

    I've also been notified that my case has been transferred to my preferred country court.

    Hoping this is all a standard part of the procedure...will let you know if I have any further updates.

    Hello Everyone,

    I've just come home to the following letter.

    Is this normal? It looks like a court date that I can choose to attend or not. Everyone here assured me that it wouldn't go to court and that it was all just scare mongering...

    What happens now?

    Why didn't you bother to read that thread - at least the first few posts on it?

    And it is still the expectation of 'everyone here' that there will be no hearing.


    Anyway, that aside, you still have to play the game.
    Note 6) on that Notice says...

    You need to work towards creating a Witness Statement and gathering evidence just in case DCB Legal do stray from their well trodden path.

    Just so you know 

    The fact that a court date has been set does not mean that its definitely going to court, its been pencilled in on the assumption that both parties comply with the orders listed, exchanging the WS Bundles, plus submitting them to the court named on the court order by 11th November, plus the claimant has to pay the court hearing fee before the pencilled in slot is written in indelible ink 

    The claimant can discontinue at any time in the interim period, plus they have not seen your WS bundle yet so have little information to go on

    Thank you @Gr1pr that makes a bit more sense to me now. Is there a separate thread for providing WS bundles or will I find that in the newbies section? (For clarity I've read the newbies section a few times but don't remember seeing templates or examples for this. It has been months and I do find myself a bit lost in the forums sometimes though, so a point in the right direction would be a huge help.)

    @KeithP Yes I do remember that post and I did read it. I've just had a re-read now and while it lists different stages of their approach I was still unclear as to what I'm supposed to do next, hence why I asked here for a bit of clarity. The other links in the first few posts didn't help either as I didn't understand them.

    Is the witness statement and evidence I provide different from the statement used in the previous documents? I don't really have any evidence as such so not sure what I can prepare.

    Also, I've had phone calls and and email asking to settle out of court but these came before this letter.

    There are no WS examples listed because they are soon out of date and bespoke for the case they are in

    You are expected to follow the instructions on the court order that you receive from the local court that you nominated 

    This includes exchanging and submitting your WS plus Exhibits bundle, same as everyone else has to, so you study recent examples at the time when your bundle is being drafted and compiled 

    Everyone writes a WS, a WS is not the same as the defence, its more detailed, with numbered exhibits, everyone has Exhibits, some are linked in the second post in the newbies sticky thread in announcements 

    Its your task to keep up to date, follow the court order and study other peoples progress and examples in order to compile your own bundle 

    The second post in the newbies sticky thread explains the WS bundle stage, but you find your own examples, no templates

    You should start by studying the discontinuations thread by Umkomaas, starting from the end and work backwards, because the latest cases are always at the end, over 420 and rising, so plenty of examples of chickening out
