CNBC Claim Form UKPC LTD DCB LEGAL LTD

Hi all, I've recieved a CNBC claim form from UKPC/DCBL so have been reading the forums on how to defend. I've completed the AoS and have seen the defence template but am a bit stumped for what to include for my defence in section 3. Any information I can think of seems irrelevant, so should I simply say that I was told to park there for work and only stayed that evening?

I was unaware of any signage indicating that it was permit only and I didn't receive a fine on my window or any other documentation until the claim form arrived. I have no idea if there was a time limit for parking as it's not mentioned in the PoC.

I've attached the PoC and would be grateful for any insight on what I can defend.

Apologies if I've broken any forum rules with my post, I've been reading different threads all of last night and this morning and am getting a little lost.

This is the defence template I'm referencing and editing and just wanted to check it's the correct one as I read there was an older one that had been updated.

Put this as your paragraph 3:

    3. The Defendant recognises the business park and was told to park there for work, being fully authorised by one of the businesses.  The Defendant did not see any signage indicating that it might be 'paper permit only' and did
not receive a PCN at all, neither on the car windscreen nor any documentation by post until the claim form arrived. The Defendant has no idea if there was a time limit for parking nor how to obtain 'authorisation' as it is not mentioned in the claim.  Nor has the Defendant ever seen a copy of the purported contract (sign) they are alleged to have breached (which is denied because no sign was seen/read).

Why did no papers arrive until the claim form? Only state this if it is TRUE.

Surely you received a LBC from DCB a few weeks ago?

If the above is true, is it because you forgot to update the address on your V5C?

No-one can receive zero letters from UKPC unless they had an old address from the DVLA.  What went wrong?

Or did you in fact receive letters but ignore?

I moved house just before the parking event and it did take a while for the new V5C to get processed as my belongings were in storage.

I did wonder if perhaps they kept my previous address on their system and then it only updated when sending the recent claim form?

Unless my housemate threw them away but I don't think that's likely!

Should I omit any references to not recieving a PCN to my current address, just in case they have sent one that I haven't seen? As I agree it's strange that no previous documentation would have been sent at all.

Thanks for all your help so far. I have added the above paragraph to my defence and sent it off. Recieved an automated reply stating it had been recieved.

Normal type claim from DCBL that will no doubt lead to their famous discontinue laek ... especially as it's UKPC

UKPC has very dofy signs so proof in pictures is a key to their claim

DCBL CLAIM DAMAGES ,,,,, WHAT DAMAGES ???  UKPC are not entlitled to f
damages ?   This word is designed to mislead the court and the £79 fake add one is an amount to line the pocket of DCBL

Who are DCBL claiming the fake DAMAGES for ???

And then, there is Ellen who signed this as a statement of truth, a fake claim can mean that Ellen is in contempt of court

Let us know what DCBL AND THEIR GAME continues

Just standard response from DCB Legal as they trudge along the usual path towards discontinuation. Keep following the process.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

UPDATE: I've now recieved the directions questionnaire which I will fill out and email according to the newbies guidlines.

Am getting quite nervous about this now though as it will be incredibly difficult to get time off from my current job (freelance) to attend a court date and I don't know where to begin in terms or arguing the case in court by myself.

Starting to think it would have been better to pay and let them get away with it... :(
