    The only part I added is 

    On the morning of 12th of October 2023 at about 9.30am the defendant was attending antenatal appointment at Wythenshawe Hospital and was running a little late. The Defendant couldn’t get a parking within hospital premises so drove up the road and saw Floats Road Car Park.  The Defendant drove into the Car Park and bought a parking ticket from the machine for up to 4 hours which was £2.50.  As the Defendant entered the premises it stated Pay and Display so bought the ticket and displayed ticket on the dashboard of the vehicle. 

    The Claimant has stated that the Defendant breached the terms and conditions; namely parked without purchasing a valid Pay and Display ticket however failed to prove or provide evidence of the car parked with no ticket displayed.



    Is this all good or is there anything else to add or change please?

    I have till 29th of April to submit the defence

    You need to add the usual wording about Excel and VCS confusion. We've seen this loads of times and it is in defences referring to them by their company numbers (which is what to search the forum for).

    But we still haven't seen the NTK.

    You need to add the usual wording about Excel and VCS confusion. We've seen this loads of times and it is in defences referring to them by their company numbers (which is what to search the forum for).

    But we still haven't seen the NTK.
    I seem to have mistakenly disposed off the NTK letter as I’m search all through my letters and can’t find it

    Finalising my defence and will like to check if wording all ok or do I need to change anything please. Will copy defence template and add in this once I get confirmation it’s all good.

The signs in the car park mentioned Vehicle Control Services as the Creditor who will undertake parking enforcement however they also discuss the limited liability of Excel Parking Services Ltd. How is the Defendant to know with any certainty which company, if any , they are deemed to have agreed a contract with.

    Yes, you have the point back to front.

    The sign was headed 'Excel Parking Services Ltd' and when the Defendant contacted 'myparkingcharge' online (presumably thinking there was an appeal service, which there wasn't) the reply was from Excel Parking Services Ltd, who were the entity processing the data obtained from the DVLA.  Therefore any contract was offered by that legal entity, not this Claimant.

    This has come up before. Search the forum for VCS Excel company number defence.
