    Quick update. Got my court date - 14 august. If the claimant doesn’t pay the trial fee by 17 July, the case gets struck out. Already filed my defence, just need to prepare the witness statement and bundle closer to the date.  Funny enough, in a similar case my friend had with the same company, they backed out just before the trial fee deadline. If they do the same with me, does anyone know if there’s a way to counter-sue or claim costs? Curious what options are on the table.

    Study the discontinuations thread by Umkomaas to see how many chicken out just before the hearing fee needs paying,  over 600 at the moment   !

    To counter sue you had to include it at the defence stage and pay the fee to the CNBC,  so not on the table , especially as you probably have no legal grounds to counter sue 

    If you win you can ask for your costs assessment to be granted  ( include it with your WS bundle,  plus proof of loss of pay etc ) it's typically pegged at £95 plus a few minor expenses like car parking fee and petrol etc ( certainly not a lottery win  )

    This is already covered for you in the NEWBIES thread (second post) about costs after a late discontinuance.

    Please stand up and be counted (for our Government evidence resources) to help regulate this industry:

    could you post a redacted image of both YOUR notice of discontinuance when it arrives (not the email, the attached NoD) and your friend's NoD too.

    @Umkomaas can then add them to his disco thread. Two for the price of one!

    Your friend will still have the email I bet - can we see their NoD now please? Redact their data & claim number. This is important as the disco thread is supplied as evidence to the MHCLG regularly.
