    Thanks for above. And while every discontinuation is something to celebrate, I am only counting those discontinued by DCB Legal. This one looks like it's a Civil Enforcement Ltd case they have been pursuing themselves. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Ah yes, I was going by the claim form posted yesterday but that's a new DCB Legal claim.

    Ah yes, I was going by the claim form posted yesterday but that's a new DCB Legal claim.

    Thats correct, there were two vehicles involved, but the claims were submitted at different times. This is a new claim, now filed against me. Should I include photos in my defence, or would it be more appropriate to present them at a later stage in the process?

    I’m ready to fight this claim and see it through, just like what happened with my friends case. That claim was a complete jokes, we even had to drive to the Northampton court to deliver the documents in person (1h drive luckily), and they still managed to lose them. My friend had to resend everything by email, even though they had already confirmed receipt of the original documents.

    The Defence doesn't require evidence (photos etc). Save those for the Witness Statement stage. 

    Why are you driving things to the Northampton Court (do you mean the Northampton CNBC?)?  Email is much safer and traceable in the event of any receipt disputes.

    Perfect, one more question before I submit my defence does paragraph 2. Apply to my POC?

    2. The facts in this defence come from the Defendant's own knowledge and honest belief.  Conversely, the Claimant sets out a cut-and-paste incoherent and sparse statement of case. The POC appear to be in breach of CPR 16.4, 16PD3 and 16PD7, and fail to "state all facts necessary for the purpose of formulating a complete cause of action". The Defendant is unable, on the basis of the POC, to understand with certainty what case, allegation(s) and what heads of cost are being pursued, making it difficult to respond. However, the vehicle is recognised and it is admitted that the Defendant was the registered keeper and driver.

    Yes, we went to the Northampton CCBC. My friend had emailed them everything before the deadline, and they even acknowledged it. But a month later, he got a letter saying they hadn’t received anything. He tried calling for a week with no luck, so we decided to take a road trip and drop it off in person. A month later, the same thing happened: his defense was lost ,and he had to resubmit it again via email. Eventually, the case was allocated to a local court, but it ended up being dropped.

    And we assume para 3 is this one with the date changed?

    Please delete that 'defence' post as it is out of date.  It's also making your thread too long, which puts people off who only have a minute to skim-read each thread/post each day.

    Instead go to the thread by @shahib_02 and use the new para 3 - and don't show us the whole defence please, not the whole template even though you are using it all!
    Fingers crossed here for you also but could you now complete the request as above by @Coupon-mad to delete your old defence post.

    Keeping mine crossed too.

    I believe this parking industry has no desire to treat motorists fairly. Seems some MPs agree. One recently told Parliament "Rip-off 'fines' need to go" See letter a group wrote to HCLG Minister 

    We need to keep pressure on MHCLG to action. Get your MP to ask MHCLG when the Govt Parking Code of Practice will be re-introduced. Join the motorists demand for a Govt-backed CoP.
