Excel appealing court decision
Comments
-
I ve had some difficulty attaching photos but should be ok now. I was anxious about what was wise to share or not share. I ve deleted any of their names and my info like my registration.
as you can see they are appealing on 3 grounds. The judge didn't even mention the second in court about entering a VRM being an unfair term so I am not sure where excel have picked that out from. I ve included the judgement letter from court too.
for ground 3 the judge said the amount being asked for by excel was not proportionate. They had evidence I paid £3 (plus 20p for using the app).
I ve looked at these forums a lot over the past year when anxiously fretting about what excel were going to do next and I ve never seen anyone talk about excel appealing so it came as a bit of a shock today. I thought the whole thing was over with.

In my opinion that appeal shoots them down in flames, they talk about the importance of and need for a correct VRM but the car park equipment allowed you to input an incorrect (well no) VRM!5

I don't think it does them well at all either with what it says about the judge0 -
Excel are IPC members. The IPC has a Get Your Reg Right campaign going. As part of that, the IPC made a statement on Twitter that it was a moral duty for all it's members to install typo proof machines, and called it their mantra.Le_Kirk said:In my opinion that appeal shoots them down in flames, they talk about the importance of and need for a correct VRM but the car park equipment allowed you to input an incorrect (well no) VRM!
Unfortunately the link I had to the Twitter messages has disappeared following the change to X.
If anyone has a screen grab of them, or can access them via X, it would be useful to post them here for this and many other cases.I married my cousin. I had to...I don't have a sister.

Not from Twitter; but, it does include support for the IPC's campaign from a former Chancellor even though it doesn't apply to Helicopters.

Thanks. That's useful, but it would be good if we can get the IPC's statements where they say it is a moral duty for parking operators to install typo proof machines. In my opinion, the Get your reg right campaign is just a cover for blaming the motorist and pretending to help them at the same time.Castle said:Not from Twitter; but, it does include support for the IPC's campaign from a former Chancellor even though it doesn't apply to Helicopters.

What we need is the statement where the IPC say their members must do something about the problem.I married my cousin. I had to...I don't have a sister.

Thanks for that @CastleCastle said:Not from Twitter; but, it does include support for the IPC's campaign from a former Chancellor even though it doesn't apply to Helicopters.

Although the link at the end of that article doesn't work, this one does...
www.getyourregright.info.
That in turn leads to a webpage showing companies that support the 'Get Your Reg Right' campaign...
www.getyourregright.info/endorsements
But wait... there's more.
If one were to click on that Excel Parking logo on that webpage - or on the image above - we see this glowing message of support for the campaign from Excel's leader...
Isn't it good that Excel Parking Services Ltd are so open with their support for this campaign?3 -
I think the Circuit Judge might well grant leave to appeal on maybe one ground and will require Excel to cough up a transcript of the first hearing in order to take it to a hearing. You will need help.
I am not sure if you should serve a Respondent's Notice yet.
